LMB MEMORANDUM CIRCULAR NO. 004-14
| SUBJECT | : | Amending Sections 75 and 76 of the Manual of Lands Survey Procedures |
In order to facilitate the approval of the Cadastral Survey Projects, Sections 75 and 76 of the Manual on Land Survey Procedures as adopted under DENR Memorandum Circular No. 2010-13, are hereby amended as follows: ITaESD
SECTION 1. Section 75 shall read as follows:
"Section 75. In case of boundary dispute, the following shall be observed.

e. The Geodetic Engineer/Contractor concerned shall exert diligent effort to give LGUs the opportunities to arrive at an agreement through the conduct of at least three (3) meetings. This should be stated in the Terminal Report, which shall form part of the Survey Returns under oath, with the following additional attachments:
1. Notices of Meeting properly received by the concerned LGUs;
2. Minutes/results of the meetings and the agreements, if any;
3. Pictures during the meetings; and the
4. Attendance sheets."
SECTION 2. Section 76 shall read as follows:
"Section 76. In case the boundary dispute is not settled before the completion of the field work of the cadastral project despite the diligent efforts on the part of the surveyor concerned to facilitate the settlement of the same, the disputed area with all the lots contained therein shall be surveyed and treated as a separate cadastral case and shall be indicated on the map with VS (versus). If the dispute is with the previously approved Cadastral Survey, dotted lines shall be plotted on the CM and indicate therein the VS.
In case the LGUs refused to cooperate with the surveyor and the claimed areas were not pointed on the ground, the law on the creation of the LGUs shall be used as the primary basis. Actual survey based on the natural features at that time of the creation and the mutual agreement of the concerned LGUs shall prevail in the absence of the technical description. The presence of boundary conflict shall prevent the DENR Regional Office concerned in approving the cadastral project."
This Memorandum Circular shall take effect immediately.
