PNP MEMORANDUM CIRCULAR NO. S2012-0228
AMENDING SECTION 10, RULE IV OF THE 2003 REVISED RULES AND REGULATIONS IMPLEMENTING REPUBLIC ACT NO. 5487, AS AMENDED
1. References:
a. R.A. No. 5487, as amended, entitled "An Act Governing the Organization and Management of Private Security Agencies, Company Guard Forces and Government Security Forces";
b. Section 17, R.A. No. 5487 on the "Rules and Regulations by Chief, Philippine Constabulary (now PNP)"; and
c. The 2003 Revised Rules and Regulations Implementing R.A. No. 5487, as amended.
2. Purpose:
This Circular aims to amend the provisions of Section 10, Rule IV of the 2003 Revised Rules and Regulations Implementing Republic Act No. 5487 (R.A. No. 5487), as amended, to remove from the list of documentary requirements those that are not required under the provisions of R.A. No. 5487.
3. Scope/Application:
This amendment applies to all applications for License to Operate (LTO) that may be filed after the effectivity of this Memorandum. DcICEa
4. Amendment:
Section 10, Rule IV of the Revised 2003 Rules and Regulations Implementing R.A. No. 5487, as amended, is hereby amended to read as follows:
Section 10. Supporting Documentary Requirements for new application.
a. Supporting Documents accompanying applications for New License to Operate:
1) Endorsement from RDs, PROs with Inspection Report and Certification from Provincial/City Director that there is a demand for security services or a need for PSA, PDA, CGF or GGU (for regional/provincial application only);
2) Computerized Sketch of Principal/Main Office Location (indicating exact office address) with E-mail Address;
3) Accomplished SOSIA Application Form (SOSIA 09-11) with original or photocopy of Staff Licenses (SO/SC);
4) Registration Certificate with DTI/SEC together with its Application Form with DTI BN Receipt/By-Laws and Articles of Incorporation;
5) Biodata/Information Sheet of Licensee (Typewritten);
6) Licensee's College Diploma/Transcript of Records or Authenticated Retirement Order (AFP/PNP/BJMP/BFP/NBI);
7) List of Prospective Clients;
8) Project Feasibility Study;
9) Letter Request for Authority to Purchase Firearms from Authorized Gun Dealers/Store addressed to the Director CSG-Attn.: Chief, SOSIA; CDESIA
10) SBR/Official Receipt for National License Fee (P2,500 per year);
11) Registration Fee (P50.00 per guard) per year;
12) Surety Bond with policy covering the amount of P50,000.00 for 2 years;
13) PAG-IBIG Certificate of Employer Registration (COER);
14) Bank Certificate of Deposit (Minimum P500,000.00) with machine validation;
15) Private Security Operators Training Seminar with LA validated by STMD;
16) Affidavit that the agency applying has a furnished office and PNP-approved firearms vault;
17) Affidavit that PSA will have at least 200 guards posted within two (2) years after the date of approval of Temporary LTO;
18) PNP Clearance (DI/RID Clearance);
19) NBI Clearance;
20) Neuro-Psychiatric Test Result (Validated by the PNP Health Service);
21) Drug Test.
b. Supporting Documents accompanying applications for Regular License to Operate:
1) Endorsement from RD, PROs with duly accomplished Inspection Checklist;
2) Computerized Sketches of principal/main/branch Office Location with E-mail Address;
3) Accomplished SOSIA Application Form (SOSIA 09-11) with original or photocopy of Staff License/s (SO/SC);
4) Notarized Disposition of Guards, Clients and Firearms with Gains and Losses;
5) Firearm Records Verification/FIMS and Certification from FEO;
6) Alphabetical Listing of Guards by Birth month;
7) SBR/Official Receipt for National License Fee;
8) SBR/Official Receipt for PNP Registration Fee; CIAHaT
9) VAT and other local government tax payments;
10) Agency's/Company's Firearm License Fee;
11) Surety Bond for the period of validity of the license;
12) PAG-IBIG Clearance;
13) BIR Clearance;
14) National SSS Clearance;
15) DOLE Clearance;
16) PNP DI Clearance;
17) Neuro-Psychiatric Test Result (Validated by the PNP Health Service);
18) Drug Test;
19) Certification of Private Security Agency Operator's Training Seminar with LA validated by STMD;
20) Mayor's permit (Where principal/branch/main office is located); and
21) License to Operate (Previous)
5. Repealing Clause:
The provisions of Rule IV, 2003 Revised Rules and Regulations Implementing R.A. No. 5487, as amended, and all rules and regulations which are inconsistent with this are hereby repealed, amended or modified accordingly.
6. Effectivity:
This Circular shall take effect fifteen (15) days following the completion of its publication in the Official Gazette or in a newspaper of general circulation. aTcHIC
