EXECUTIVE ORDER NO. 62
AMENDING EXECUTIVE ORDER NO. 1 (S. 2016), ENTITLED "REENGINEERING THE OFFICE OF THE PRESIDENT TOWARDS GREATER RESPONSIVENESS TO THE ATTAINMENT OF DEVELOPMENT GOALS," AND FOR OTHER PURPOSES
WHEREAS, Presidential Decree (PD) No. 4 (s. 1972), as amended, created the National Food Authority (NFA) in order to strengthen the national strategy for the integrated growth and development of the food industry to ensure adequate and continuous supply at reasonable prices;
WHEREAS, PD No. 232 (s. 1973), as amended, created the Philippine Coconut Authority (PCA) to promote the accelerated development of the coconut and other palm oils industry;
WHEREAS, PD No. 1144 (s. 1977), as amended, created the Fertilizer and Pesticide Authority (FPA) to exercise jurisdiction over all existing handlers of pesticides, fertilizers and other agricultural chemical inputs;
WHEREAS, Executive Order (EO) No. 165 (s. 2014), transferred the NFA, PCA and FPA from the Department of Agriculture (DA) to the Office of the President (OP);
WHEREAS, EO No. 90 (s. 1986) created the Housing and Urban Development Coordinating Council (HUDCC), under the immediate control and supervision of the OP, with the main function of coordinating the activities of the government housing agencies to ensure the accomplishment of the National Shelter Program;
WHEREAS, EO No. 357 (s. 1989) granted the HUDCC overall administrative supervision over the key housing agencies, and EO No. 20 (s. 2001) further strengthened it by mandating it, among others, to serve as the sole lead agency to assist the President in the formulation and implementation of the national objectives, policies, and strategies for housing and urban development, and to coordinate and monitor the activities of all government agencies undertaking housing projects, including those of local government units;
WHEREAS, EO No. 1 (s. 2016) placed the NFA, PCA and HUDCC under the supervision of the Cabinet Secretary;
WHEREAS, the transfer of the NFA, PCA and FPA to the DA and the supervision over the HUDCC by the OP will ensure efficiency and coordination in the performance of their respective mandates, consistent with the efforts to streamline the operations of government;
WHEREAS, there is a need to reorganize the NFA Council for the effective formulation and coordination of a comprehensive program for the development and promotion of efficiency and productivity in the food industry;
WHEREAS, under Section 31, Chapter 10, Book III of EO No. 292 or the Administrative Code of 1987, the President has the continuing authority to reorganize the administrative structure of the OP, including transferring any agency under the OP to any department or agency and vice versa;
WHEREAS, Section 84 of the General Provisions of Republic Act No. 10964 or the "General Appropriations Act of 2018" provides that the President is authorized to create new offices and modify the existing organizational structure of the agencies in the Executive branch, as well as create new positions or modify existing ones whenever public interest so requires; AIDSTE
WHEREAS, under Article VII, Section 17 of the 1987 Constitution, the President shall have control over executive departments, bureaus and offices;
NOW, THEREFORE, I, RODRIGO ROA DUTERTE, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:
SECTION 1. Section 1 of EO No. 1 is hereby amended to read as follows:
"Section 1. Agency Supervision. — The Cabinet Secretary shall have supervision over the following agencies:
a. Cooperative Development Authority
b. National Anti-Poverty Commission
c. National Commission on Indigenous Peoples
d. National Commission on Muslim Filipinos
e. National Youth Commission
f. Office of the President-Presidential Complaint Center
g. Philippine Commission on Women
h. Presidential Commission on the Urban Poor
i. Technical Education and Skills Development Authority
With the supervision of the Cabinet Secretary, these agencies shall primarily evaluate existing poverty reduction programs and, if deemed necessary, formulate a more responsive set of programs complementing existing ones, channeling resources as necessary to reduce both the incidence and magnitude of poverty.
They shall develop specific programs and projects that seek to reduce poverty, improve the lives of the most vulnerable sectors of society; promote social education of the people to allow them to participate in effecting real change by keeping watch of the affairs of the government; and listen to people's feedback.
They shall conduct consultations with LGUs for the proper allocation of resources and program implementation and recommend courses of action for the government to adopt in order to achieve a sustainable system of meeting the needs of the people, while ensuring resiliency for vulnerable communities."
Except for the foregoing amendments, all other provisions of EO No. 1 shall remain unchanged.
SECTION 2. The supervision over the NFA, PCA and FPA is hereby transferred to the DA. Further, the OP shall continue to exercise immediate control and supervision over the HUDCC.
SECTION 3. The NFA Council shall be reorganized as follows:

SECTION 4. All issuances, orders, rules and regulations, or parts thereof, which are inconsistent with this Order are hereby repealed, amended or modified accordingly.
SECTION 5. If any section or part of this Order is held unconstitutional or invalid, the other sections or provisions not otherwise affected shall remain in full force or effect.
SECTION 6. This Executive Order shall take effect immediately.
