PNRI ADMINISTRATIVE ORDER NO. 02-06
ADOPTION OF IAEA CODE OF CONDUCT ON THE SAFETY AND SECURITY OF RADIOACTIVE SOURCES AND IAEA GUIDANCE ON THE IMPORT AND EXPORT OF RADIOACTIVE SOURCES
WHEREAS, pursuant to RA 2067 and RA 5207, both as amended, the PNRI is mandated to regulate and license the safe use of radioactive sources in medicine, research, and industry, for the protection of the health and safety of the workers and the general public from the potential hazards of radiation; aCcADT
WHEREAS, the PNRI is authorized to promulgate rules and regulations that govern the importation, exportation, and transportation of radioactive sources;
WHEREAS, the PNRI recognizes the need for licensees to have a clear understanding on the specific safety and security requirements, and the regulations that apply to the import and export of radioactive sources;
WHEREAS, there is a need for PNRI to ensure that licensees involved in importing radioactive sources have the appropriate technical and administrative capability and resources needed for the management of the sources;
WHEREAS, the PNRI recognizes the need for licensees involved in export to determine that the importing country has the appropriate technical and administrative capability, resources and regulatory infrastructure needed for the management of the radioactive source in a manner consistent with the guidance in the Code;
WHEREAS, there is a need for PNRI to ensure that licensees who export are able to confirm from the importing country that the consignee is authorized by the Competent Authority of the importing country to receive and possess the radioactive source in accordance with its laws and regulations;
Now, THEREFORE, pursuant to the provisions of Section 4 of Republic Act No. 5207, as amended, the PNRI hereby adopts the provisions of the IAEA Code of Conduct on the Safety and Security of Radioactive Sources and in order to be properly guided in its compliance with the IAEA Code of Conduct, the PNRI shall likewise conform to the provisions of the IAEA Guidance on the Import and Export of Radioactive Sources as far as practicable.
This Order shall take effect fifteen (15) days after its publication in the Official Gazette.
