LLDA BOARD RESOLUTION NO. 523-17
ADOPTION OF DEPARTMENT ADMINISTRATIVE ORDER (DAO) NO. 2016-08 OF THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES (DENR) AS THE NEW EFFLUENT STANDARDS FOR THE CONTINUOUS IMPLEMENTATION OF THE ENVIRONMENTAL USER FEE SYSTEM AND THE WATER QUALITY GUIDELINES FOR SURFACE WATERS WITHIN THE LAGUNA DE BAY REGION, AND FOR OTHER PURPOSES
WHEREAS, Republic Act No. (RA) 4850, as amended, empowers the Laguna Lake Development Authority (LLDA) to issue rules and regulations as may be necessary to effectively carry out its mandate;
WHEREAS, Section 19e and 19f of RA 9275, otherwise known as the Philippine Clean Water Act of 2004, stated the need to review and set a new effluent standards after the effectivity of said Act and at the interim, the standards set in DENR DAOs No. 34 and 35, series of 1990 shall remain in effect until such time that a new standard is established by the DENR;
WHEREAS, Board Resolution No. 33, Series of 1996, "Approving the Rules and Regulations Implementing the Environmental User Fee System in the Laguna de Bay Region", adopts the provisions of DENR DAO 35 for the implementation of effluent regulations;
WHEREAS, RA 9275 further recognizes the implementation of Environmental User Fee System in the Laguna de Bay Region by the LLDA;
WHEREAS, on May 24, 2016, the DENR adopted and promulgated DENR DAO No. 2016-08 or the Water Quality Guidelines and General Effluent Standards, pursuant to RA 9275;
WHEREAS, as an attached agency of the DENR, the LLDA deems it appropriate to adopt the new effluent standards and water quality guidelines to ensure uniform implementation of said standards and guidelines, pursuant to the provisions of RA 9275;
NOW, THEREFORE, foregoing premises considered and pursuant to the provisions of Republic Act No. 4850, as amended by Presidential Decree No. 813 and Executive Order No. 927. BE IT RESOLVED, as it is hereby RESOLVED, to adopt the provisions of the general effluent standards under DENR DAO No. 2016-08 as part of the Rules and Regulations Implementing the Environmental User Fee System and water quality guidelines for surface waters within the Laguna de Bay Region, and for other purposes.
RESOLVED, FINALLY, that this Resolution shall take effect thirty (30) days after publication in a newspaper of general circulation and registration in the Office of the National Administrative Register (ONAR).
