A.C. NO. 6907
Sirs/Mesdames :
Quoted hereunder, for your information, is a resolution of this Court dated 02 July 2008:
A.C. No. 6907 (Ferdinand A. Cruz vs. Atty. Stanley R. Cabrera) — The Court resolves to NOTE:
(1) complainant's urgent manifestation pointing material flaws in the findings of facts of the Investigating Commissioner in his report to aid the Court in its final action on the IBP Board Resolution dated 06 February 2008;
(2) complainant's letter addressed to the Chief Justice, stating that respondent has not changed a bit since he was first cited in contempt by this Court in 1979 as shown by the attached citations for contempt against respondent from 1979 to the present; and
(3) respondent's letter stating that complainant has published the aforesaid IBP Board Resolution in violation of the IBP Commission on Bar Discipline's Rules of Procedure, and to DENY his prayer that complainant be sanctioned for lack of merit. EaCSTc
Acting on the complaint against respondent, the Court further resolves to ADOPT and APPROVE, the findings of fact, conclusions of law and recommendation of the Investigating Commissioner in the attached Report and Recommendation dated 29 January 2008 as approved with modification by the Board of Governors of the Integrated Bar of the Philippines in its Board Resolution No. XVIII-2008-82 dated 06 February 2008. Accordingly, respondent is SUSPENDED from the practice of law for six (6) months for violation of Canon 8, Rule 8.01 of the Code of Professional Responsibility for using uncalled for and inappropriate, deplorable and unprofessional remarks in his pleadings.
