Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedDecember 3, 2018which reads as follows:
"G.R. No. 241733 — Albert R. Te Eng Fo, Petitioner, v. National Grid Corporation of the Philippines, Henry T. Sy, Jr., Josena Paz Uybarreta and Nelson F. Cabangon, Respondents.
Considering the allegations, arguments and issues raised in the instant Petition for Review on Certiorari, the Court resolves to DENY the same for: (i) lack of verified statement as to the dates of receipt of the assailed Decision and of the filing of the motion for its reconsideration; 1 (ii) failure to attach to the Petition a copy of the assailed Decision; 2 and, (iii) failure to show that the Court of Appeals (CA) in CA-G.R. SP No. 07699-MIN committed any reversible error in affirming the Decision of the National Labor Relations Commission in NLRC No. MAC-03-014361-2016.
Petitioner insists that the acts of respondents reflected how he was constructively dismissed such that he faults the CA in affirming the dismissal of his complaint.
It bears stressing, however, that the Court is not a trier of facts and only questions of law may be raised in a petition for review on certiorari, 3 as the one at bench. There being no showing that the Decision of the CA (a copy of which was not attached to the petition) falls within the exceptions to the aforesaid rule, we have no reason to alter, reverse or modify the CA ruling which affirmed that of the labor tribunals dismissing petitioner's complaint for illegal dismissal. ACCORDINGLY, the Court resolves to AFFIRM the April 4, 2018 Decision and July 16, 2018 Resolution of the Court of Appeals in CA-G.R. SP No. 07699-MIN.
The counsel for petitioner is hereby required to submit his contact details (telephone number, cellphone number and/or e-mail address), within 10 days from receipt of this Resolution pursuant to A.M. No. 07-6-5-SC dated July 10, 2007.
Moreover, petitioner or his authorized representative may claim from the Cash Collection and Disbursement Division his excess payment for the legal fees in the amount of P1,470.00 under O.R. No. 0224345-SC-EP dated September 19, 2018.
