NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated March 18, 2021which reads as follows:
"G.R. No. 254557 — (JONATHAN SUAREZ y ORDONIO, petitioner v. PEOPLE OF THE PHILIPPINES, respondent). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
This Court has carefully reviewed the allegations, issues and arguments adduced in the instant petition for review on certiorari and accordingly resolves to DENY the same for failure to show that the Court of Appeals committed any reversible error in its December 12, 2019 Decision 1 and November 24, 2020 Resolution 2 in CA-G.R. CR No. 42597. However, applying the Indeterminate Sentence Law, petitioner's sentence should be modified.
WHEREFORE, the Decision and Resolution of the Court of Appeals in CA-G.R. CR No. 42597 finding petitioner JONATHAN SUAREZ y ORDONIO GUILTY beyond reasonable doubt of violation of Section 28 (a) in relation to Section 28 (e) of Republic Act No. 10591 is hereby AFFIRMED with MODIFICATION that petitioner is sentenced to suffer the indeterminate penalty of eight (8) years and one (1) day of prision mayor, as minimum, to ten (10) years, eight (8) months and one (1) day of prision mayor, as maximum.
