NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated September 11, 2019which reads as follows:
"G.R. No. 225737 (People of the Philippines v. Elvis Suarez y Lucero)
Considering the allegations, issues and arguments presented in the appellant's and the appellee's briefs, which the parties adopted instead of filing their respective supplementary appeal briefs, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in its assailed October 6, 2015 Decision, 1 as to warrant the exercise of this Court's appellate jurisdiction. DACcIH
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the October 6, 2015 Decision of the Court of Appeals in CA-G.R. CR-HC No. 05349, and AFFIRMS with MODIFICATION said Decision finding appellant Elvis Suarez y Lucero GUILTY beyond reasonable doubt of the crime of Murder under Article 248 of the Revised Penal Code.
In accord with prevailing jurisprudence, appellant is ordered to pay the heirs of Ramon Manlaque Lumbang the amounts of P75,000.00 as civil indemnity, P75,000.00 as moral damages, and P75,000.00 as exemplary damages. All monetary awards are subject to interest at the rate of six percent (6%) per annum computed from the finality of this judgment until fully paid.
