Please take notice that the Court, First Division, issued a Resolution dated July 1, 2015 which reads as follows:
"G.R. No. 216885 (Nancy Jacinto Samonte, Editha Jacinto Bueno, Filipinas Basilia Jacinto-Lejao, Jose M. Jacinto, and Flordeliza Jacinto Pacol-Campos, represented by Nancy Jacinto-Samonte v. Patrocinio J. Miguel, Spouses Dexter S. Corden and Bernadette S. Corden, Spouses Larry De Vera and Ligaya De Vera, et al.). — The petitioners' motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After a judicious review of the records, the Court resolves to DENY the instant petition and AFFIRM the July 22, 2014 Decision 1 and January 23, 2015 Resolution 2 of the Court of Appeals (CA) in CA-G.R. CV No. 98468 for failure of petitioners Nancy Jacinto-Samonte, Editha Jacinto Bueno, Filipinas Basilia Jacinto-Lejao, Jose M. Jacinto, and Flordeliza Jacinto Pacol-Campos, represented by Nancy Jacinto-Samonte (petitioners) to show that the CA committed any reversible error in ordering the remand of their case to the Regional Trial Court of Laoag City, Branch 14 for trial on the merits.
As correctly ruled by the CA, the submissions of petitioners and respondents regarding the purported conveyance of the former's respective shares to respondent Patrocinio J. Miguel, as well as the validity of her subsequent conveyance of the subject lands to her co-respondents, present genuine issues of fact that necessitate a presentation of competent and relevant evidence, which can only be done in a full-blown trial, and not through a summary judgment. 3
