RE: QUERY OF FISCAL MANAGEMENT AND BUDGET OFFICE ON EMERGENCY ECONOMIC ASSISTANCE
NOTICE
Sirs/Mesdames :
Please take notice that the Court en banc issued a Resolution dated MAY 8, 2012, which reads as follows:
"A.M. No. 12-4-9-SC (Re: Query of Fiscal Management and Budget Office on Emergency Economic Assistance). — The Court Resolved to:
(a) NOTE the
(i) Letter/Petition for Reconsideration dated May 2, 2012 filed by Mr. Jose Dante E. Guerrero, President, Supreme Court Employees Association;
(ii) Letter dated May 4, 2012 of Amiel C. de Vera, President, Association of Court of Appeals Employees, Rm. 205, CA Centennial Bldg., Ma. Orosa Street, Ermita, Manila; and
(iii) Memorandum dated May 7, 2012 of Atty. Corazon G. Ferrer-Flores, Deputy Clerk of Court and Chief of Office, Fiscal Management and Budget Office;
(b) AUTHORIZE the grant and release of a minimum rate of Ten Thousand Pesos (P10,000.00) for the Emergency Economic Assistance (EEA) under Memorandum Order Nos. 09-2012 and 09A-2012, such that judiciary employees who previously received the EEA at the rate of their one month basic salary below P10,000.00 shall be authorized to receive the difference, subject to the same guidelines under the said memorandum orders;
(c) ORDER that the status quo prevailing before the issuance of the resolution dated April 24, 2012 on the grant and release of the EEA be maintained pending the resolution of the issue of whether the EEA is a fringe benefit or not;
(d) ORDER the immediate release of the balance of the EEA at the rate of one month basic salary, previously withheld as tax, subject to the refund of the withholding tax if it is later determined that the EEA should be subject to withholding tax; and IEcaHS
(e) REQUIRE the Office of the Chief Attorney to COMMENT on the issue of whether the EEA is a fringe benefit or not, within fifteen (15) days from notice hereof." Perez, J., on official business. (adv4)
