NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution datedJuly 19, 2017, which reads as follows:
"G.R. No. 229727 (People of the Philippines v. XYZ). — The Court NOTES:
(1) accused-appellant's Manifestation (in Lieu of Supplemental Brief) dated May 3, 2017 stating that he opts not to file a supplemental brief since no new issues material to the case were discovered;
(2) the Office of the Solicitor General's Manifestation (in Lieu of Supplemental Brief) dated May 17, 2017 stating that it would no longer file a supplemental brief as it had already thoroughly and exhaustively discussed the issues in its appellee's brief; and
(3) the letter dated May 14, 2017 of P/Supt. I Roberto R. Rabo, Superintendent of the New Bilibid Prison, Bureau of Corrections, Muntinlupa City, confirming the confinement therein of accused-appellant since September 30, 2015.
After review of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in upholding the conviction of accused-appellant XYZ for the crime of rape. HTcADC
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated November 14, 2016 of the Court of Appeals in CA-G.R. CR-HC No. 07791 and AFFIRMS with MODIFICATION the Decision finding accused-appellant XYZ GUILTY beyond reasonable doubt of rape under Article 266-A of the Revised Penal Code, as amended, sentencing him to suffer the penalty of reclusion perpetua, and to pay AAA P75,000.00 as civil indemnity, P75,000.00 as moral damages, and P75,000.00 as exemplary damages. 1 All damages awarded shall earn interest at the legal rate of six percent (6%) per annum from the date of finality of this judgment until fully paid. 2 CAIHTE
