NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated March 4, 2020, which reads as follows:
"G.R. No. 245309 (PEOPLE OF THE PHILIPPINES, plaintiff-appellee, v. ALEX VILLARBA y BERGADO @ "BULIK," accused-appellant). — Accused-appellant Alex Villarba y Bergado alias "Bulik" was charged before and convicted by the Regional Trial Court of Batangas City, Branch 84, of the crime of illegal sale of dangerous drugs, penalized under Section 5 of Republic Act No. 9165. Pursuant to its November 13, 2018 Resolution, 1 the Court of Appeals gave due course to accused-appellant's Notice of Appeal 2 and elevated the records of this case to this Court.
In an April 8, 2019 Resolution, 3 this Court noted the case records forwarded by the Court of Appeals and informed the parties that they may file their supplemental briefs.
In its August 28, 2019 Resolution, 4 this Court noted the Manifestations filed by the Office of the Solicitor General, on behalf of plaintiff-appellee People of the Philippines, and accused-appellant, both stating that they would no longer file supplemental briefs.
After an evaluation of the records of this case, this Court resolves to DISMISS the appeal of accused-appellant for his failure to sufficiently show any reversible error in the assailed Decision5 of the Court of Appeals as to warrant the exercise of this Court's appellate jurisdiction.
WHEREFORE, this Court AFFIRMS the July 31, 2018 Decision of the Court of Appeals in CA-G.R. CR-HC No. 09406. Accused-appellant Alex Villarba y Bergado alias "Bulik" is found GUILTY of violation of Section 5 of Republic Act No. 9165. He is sentenced to suffer the penalty of life imprisonment and is ordered to pay a fine of P500,000.00.
