Please take notice that the Court, Second Division, issued a Resolution dated14 September 2020which reads as follows:
"G.R. No. 250419 (People of the Philippines v. Anthony Pineda y Alejandre, Grace Navalta y Muñoz, and Jesselito Tabaquero y Maglalang). — The Court NOTES the manifestation (in lieu of supplemental brief) dated 20 July 2020 of counsel for accused-appellants Anthony Pineda y Alejandre (Pineda), Grace Navalta y Muñoz (Navalta), and Jesselito Tabaquero y Maglalang (Tabaquero; collectively, accused-appellants), adopting the Appellant's Brief dated 15 August 2020 as supplemental brief in this case.
After a judicious study of the case, the Court resolves to DISMISS the appeal 1 for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in the assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the April 25, 2019 Decision 2 of the CA in CA-G.R. CR-HC No. 10040 and AFFIRMS said Decision: (a) finding Pineda and Tabaquero GUILTY beyond reasonable doubt of the crime of Illegal Sale of Dangerous Drugs, defined and penalized under Section 5, Article II of Republic Act No. (RA) 9165, otherwise known as the 'Comprehensive Dangerous Drugs Act of 2002,' and accordingly, sentencing each of them to suffer the penalty of life imprisonment, and to pay a fine in the amount of P1,000,000.00: and (b) finding Pineda and Navalta GUILTY beyond reasonable doubt of the crime of Illegal Possession of Dangerous Drugs, defined and penalized under Section 11, Article II of RA 9165, and accordingly, sentencing each of them to suffer the penalty of life imprisonment, and to pay a fine in the amount of P1,000,000.00.
