NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated07 September 2020 which reads as follows:
"G.R. No. 250035 (People of the Philippines v. Darrel Muego a.k.a. 'Bogart'). — The Court NOTES: (a) the manifestation and motion dated July 7, 2020 of the Office of the Solicitor General, adopting its brief filed before the Court of Appeals (CA), as the same had already discussed the arguments of accused-appellant Darrel Muego a.k.a. 'Bogart' (accused-appellant) contained in his brief; and (b) the manifestation (in lieu of supplemental brief) dated June 1, 2020 of the Public Attorney's Office, dispensing with the filing of supplemental brief for accused-appellant, as the matters and arguments had been sufficiently discussed in appellant's brief, and that the filing of a supplemental brief would be a mere redundancy.
After a judicious study of the case, the Court resolves to DISMISS the appeal 1 for failure to sufficiently show that the CA committed any reversible error in the assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the June 28, 2019 Decision 2 of the CA in CA-G.R. CR-HC No. 02547 and AFFIRMS said Decision finding accused-appellant GUILTY beyond reasonable doubt of the crime of Illegal Sale of Dangerous Drugs, defined and penalized under Section 5, Article II of Republic Act No. 9165, 3 otherwise known as 'Comprehensive Dangerous Drugs Act of 2002.' Accordingly, he is sentenced to suffer the penalty of life imprisonment, and to pay a fine in the amount of P500,000.00.
