FIRST DIVISION
[G.R. No. 243219. March 13, 2019.]
ASMERAH A. MACATANONG, ASLEAH P. MACATANONG AND POTRE SARAH M. MACATANONG, petitioners, vs.OFFICE OF THE DEPUTY OMBUDSMAN FOR MINDANAO AND JOHN A. MAGNO, respondents.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated March 13, 2019which reads as follows:
"G.R. No. 243219 (Asmerah A. Macatanong, Asleah P. Macatanong and Potre Sarah M. Macatanong v. Office of the Deputy Ombudsman for Mindanao and John A. Magno)
After a review of the record, the Court resolves to DISMISS the petition for failure to sufficiently show that the Office of the Ombudsman (Ombudsman) committed any grave abuse of discretion in its April 24, 2018 Resolution 1 and September 25, 2018 Order 2 in OMB-M-C-17-0336, as to warrant the exercise of the Court's appellate jurisdiction.
As correctly found by the Ombudsman, petitioners made it appear in their Personal Data Sheet (PDS) that they possessed the required eligibility for the position Teacher 1. However, verification with the Professional Regulation Commission revealed that they did not actually pass the Licensure Examination for Teachers as required under Republic Act No. 7836. 3 Indeed, making false statements in one's PDS makes an employee liable for falsification, the PDS being an entry requirement for government employment. 4 Moreover, the Court finds no reason to disturb the policy of non-interference in the exercise of the Ombudsman's constitutionally mandated powers. Hence, the Ombudsman's ruling must be respected. 5
WHEREFORE, the petition is DISMISSED. The April 24, 2018 Resolution and September 25, 2018 Order of the Office of the Ombudsman in OMB-M-C-17-0336 are AFFIRMED. CAIHTE
SO ORDERED."
Very truly yours,
(SGD.) LIBRADA C. BUENADivision Clerk of Court
