PEOPLE OF THE PHILIPPINES, plaintiff-appellee, vs. SPO2 EDGARDO MENIL y BONGKIT, accused-appellant.

NOTICE

Sirs/Mesdames :

Please take notice that the Court, Special Second Division, issued a Resolutiondated26 February 2020which reads as follows:

"G.R. No. 233205 (People of the Philippines vs. SPO2 Edgardo Menil y Bongkit). — Acting on the letter dated 20 January 2020 of SJ03 Albert C. Manalo, Officer-in-Charge, Documents Section, Bureau of Corrections, Muntinlupa City, informing the Court that accused-appellant Edgardo Menil y Bongkit died on 5 February 2018 at the DPPF Hospital A, Braulio E. Dujali, Davao del Norte as per attached death certificate of accused-appellant Menil, and considering the Decision dated 26 June 2019 which partially granted the appeal and declared accused-appellant SPO2 Edgardo Menil y Bongkit guilty of homicide, the Court resolves to:

1. NOTE the aforesaid letter dated 20 January 2020 of SJ03 Albert C. Manalo, Officer-in-Charge, Documents Section, Bureau of Corrections. Muntinlupa City; and

2. RECALL and SET ASIDE the Decision dated 26 June 2019 and the entry of judgment issued thereon in view of the death of accused-appellant on 5 February 2018. HTcADC

Let this case be considered CLOSED and TERMINATED and entry of judgment be issued accordingly. Reyes, J., Jr., J., on official leave."
