Please take notice that the Court, Second Division, issued a Resolution dated16 April 2018which reads as follows: IDSEAH
"G.R. No. 234944 (People of the Philippines v. Emil Manlapaz y Grencio)
After a judicious study of the case, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in the assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the July 19, 2017 Decision 1 of the CA in CA-G.R. CR-H.C. No. 07703 and AFFIRMS said Decision finding accused-appellant Emil Manlapaz y Grencio GUILTY beyond reasonable doubt of the crime of Homicide, as defined and penalized under Article 249 of the Revised Penal Code, as amended, sentencing him to suffer an indeterminate prison term of eight (8) years of prision mayor, as minimum, to fourteen (14) years and eight (8) months of reclusion temporal, as maximum, and to pay the heirs of victim Salvador A. Ancheta the following amounts: (a) P50,000.00 as civil indemnity; (b) P50,000.00 as moral damages; (c) P99,763.11 as actual damages; and (d) P1,372,800.00 for loss of earning capacity, with legal interest at the rate of 6% per annum on all amounts due from the date of finality of this Resolution until full payment.
SO ORDERED."
