Please take notice that the Court, Third Division, issued a Resolution datedOctober 3, 2018, which reads as follows: HTcADC
"G.R. No. 233326: (People of the Philippines, plaintiff-appellee, v. Christian Asis y Agresan, accused-appellant) — The Court of Appeals elevated the records of this case to this Court on August 25, 2017 1 pursuant to its June 8, 2017 Resolution, 2 which gave due course to the Notice of Appeal 3 filed by accused-appellant Christian Asis y Agresan.
In its October 2, 2017 Resolution, 4 this Court noted the records of this case forwarded by the Court of Appeals and informed the parties that they may file their supplemental briefs if they so desired.
In its February 19, 2018 Resolution, 5 this Court noted the separate manifestations filed by the Office of the Solicitor General 6 and by accused-appellant, 7 noting that they would no longer file supplemental briefs.
After an evaluation of the records of this case, this Court resolves to DISMISS the appeal of accused-appellant for his failure to sufficiently show reversible error in the assailed Court of Appeals April 25, 2017 Decision 8 warranting the exercise of this Court's appellate jurisdiction.
WHEREFORE, this Court AFFIRMS with MODIFICATIONS the Court of Appeals April 25, 2017 Decision in CA-G.R. CR HC No. 01961, finding accused-appellant Christian Asis y Agresan GUILTY beyond reasonable doubt of murder. In conformity with the prevailing jurisprudence, 9 this Court deems it proper to modify the amount of civil indemnity, moral damages, and exemplary damages to P75,000.00 each. The amount of P50,000.00 as temperate damages is also awarded. These amounts shall earn legal interest rate of six percent (6%) per annum from the date of finality of this Resolution until fully paid. aScITE
