G.R. No. 215538: ANGELITO S. PACULOB v. MAERSK-FILIPINAS CREWING, INC., ET AL.
Pursuant to Rule 141, Section 19 of the Rules of Court, this court resolves to GRANT petitioner's motion to declare him as indigent or pauper-litigant. 1
After considering the allegations, issues, and arguments adduced in the petition for review on certiorari assailing the Court of Appeals decision 2 dated March 31, 2014 and resolution dated August 26, 2014, this court resolves to DENY the petition for failure to show any reversible error in the assailed decision and resolution and for raising substantially factual issues. We AFFIRM the Court of Appeals decision denying petitioner's petition for certiorari and upholding the National Labor Relations Commission decision dated September 30, 2011.
However, in view of this court's ruling in Nacar v. Gallery Frames, 3 the assailed decision is MODIFIED as to the rate of legal interest.
WHEREFORE, the assailed decision is AFFIRMED with MODIFICATION in that the monetary award shall earn interest at the rate of 6% per annum from the date of finality of the judgment until fully paid.
