Please take notice that the Court, First Division, issued a Resolution dated January 7, 2019 which reads as follows:
"G.R. No. 241999 — Albert Ong y Dela Cruz, petitioner v. People of the Philippines, respondent.
This Court resolves to NOTE the entry of appearance of Atty. Jussif Don Justin F. Martil as petitioner's counsel and GRANT his request that he be furnished with copies of notices and other processes of this Court. However, this Court resolves to DENY the motion for extension of thirty (30) days from the expiration of the reglementary period on September 19, 2018 within which to file Petition for Review on Certiorari for lack of affidavit of service for copies of said motion furnished to the Court of Appeals and adverse party, in violation of Section 13 of Rule 13, in relation to Section 2 of Rule 45 of the Rules of Court.
ACCORDINGLY, this Court further resolves to DENY the instant Petition for Review on Certiorari for late filing. Besides, said Petition suffers from the following flaws: (1) affiant in the verification and certification on non-forum shopping did not present any competent evidence of identity issued by an official agency; (2) affiant in the affidavit of service did not present any competent evidence of identity issued by an official agency; (3) the affidavit of service attached to the Petition for Review on Certiorari was notarized on October 2, 2018 prior to the actual date of posting of copies of said petition on the Court of Appeals and the adverse party on October 5, 2018; and (4) counsel for petitioner's MCLE indicates "on process."
Petitioner or his authorized representative may personally claim from the Cash Collection and Disbursement Division of this Court the excess payment for the legal fees in the amount of P170.00 under Official Receipt No. 0225146-SC-EP dated October 4, 2018.
