NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated January 30, 2013, which reads as follows:
"G.R. No. 203027 (People of the Philippines v. Marcos Alcantara y Dela Cruz). — The Court resolves to NOTE and GRANT the Office of the Solicitor General's Manifestation and Motion dated December 5, 2012 praying that it be excused from filing a supplemental brief as the issues raised by appellant in his brief filed before the Court of Appeals were all fully addressed by the appellee's brief dated February 2, 2010.
The records of this case were elevated to this Court on September 3, 2012, pursuant to the Court of Appeals (CA) Resolution, dated December 7, 2011, which gave due course to the notice of appeal filed by the accused, Marcos Alcantara y Dela Cruz.
In compliance with the Court's Resolution, dated September 26, 2012, the accused and the Office of the Solicitor General filed their respective manifestations stating that they were no longer filing their Supplemental Briefs with this Court as all the matters and issues raised had already been exhaustively discussed in their respective briefs filed before the CA.
After a careful perusal of the records of the case, the Court resolves to DISMISS the appeal for the failure of the accused to sufficiently show reversible error in the challenged decision warranting the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court AFFIRMS the Decision, dated October 27, 2011, of the Court of Appeals in CA-G.R. C.R.-H.C. No. 04031.
