Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution datedAugust 22, 2022which reads as follows:
"A.C. No. 13201 [Formerly CBD Case No. 17-5261] (Very Rev. Archpriest Yitzhak Pascualito D. Monsanto v. Atty. Brilla S. Racal-Zulueta). — The Court NOTES:
1. the Integrated Bar of the Philippines (IBP) Board of Governors' (a) Notice of Resolution dated December 14, 2019 which approved and adopted, with modification, the Report and Recommendation dated September 26, 2019 of the Investigating Commissioner to dismiss the case after finding the recommendation fully supported by the evidence on record and the applicable laws and rules; and (b) Notice of Resolution No. CBD-2021-03-12 dated March 13, 2021 which denied complainant's motion for reconsideration, there being no new reasons and/or new arguments adduced to reverse the Resolution dated December 14, 2019 of the Board of Governors; both transmitted by letter dated October 5, 2021 of Director Avelino V. Sales, Jr., Commission on Bar Discipline, IBP, together with the records of the case; and
2. the manifestation cum request for on-line docket/filing fees assessment and payment portal due to COVID-19 restrictions dated September 6, 2021 of petitioner himself, stating that he filed through LBC the petition for review on certiorari, however, Annex "A" was inadvertently not included; that he was unable to personally pay the docket/filing fees due to strict travel restrictions; thus submitting the said Annex "A"; and requesting that he be assessed the docket/filing fees for his petition to be sent to his email address at [email protected] and be allowed to pay the same through this Court's on-line payment portal.
This Court resolves to ADOPT and APPROVE the findings of fact, conclusions of law, and recommendations of the Investigating Commissioner in the attached Report and Recommendation dated September 26, 2019, which the Integrated Bar of the Philippines Board of Governors likewise adopted and approved. The Complaint against Atty. Brilla S. Racal-Zulueta is DISMISSED.
