NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedAugust 10, 2015 which reads as follows:
"G.R. No. 215940 (People of the Philippines v. Spart Martinez Monsanto and Archie Casilac). — The Office of the Solicitor General's manifestation in compliance with the Resolution dated February 23, 2015 that it will no longer file a supplemental brief as all arguments relative to the issues raised have been discussed in the appellee's brief dated May 14, 2014; and the accused-appellants' manifestation in lieu of supplemental brief that they are adopting in toto the appellants' brief as their supplemental brief are NOTED.
After a judicious perusal of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in the assailed Decision as to warrant the exercise of the Court's appellate jurisdiction.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the September 4, 2014 Decision 1 of the CA in CA-G.R. CEB-CR HC No. 01114 and AFFIRMS said Decision finding accused-appellants Spart Martinez Monsanto and Archie Casilac GUILTY beyond reasonable doubt of Illegal Sale and Possession of Prohibited Drugs, sentencing each of them to suffer the following penalties: (a) life imprisonment and to pay a fine of P500,000.00 for violation of Section 5, Article II of Republic Act No. 9165, 2 otherwise known as the "Comprehensive Dangerous Drugs Act of 2002"; and (b) indeterminate imprisonment of twelve (12) years and one (1) day, as minimum, to fifteen (15) years, as maximum, and to pay a fine of P300,000.00 for violation of Section 11, Article II of the same Act.
