Please take notice that the Court, Second Division, issued a Resolution dated11 April 2018which reads as follows: cEaSHC
"G.R. No. 230035 — Alberto Mendoza and Angel Mendoza versus Francisco Bagatua, Florencio Bagatua and Heirs of Angelina Bagatua, represented by Anselmo S. Eugenio and the Department of Agrarian Reform Adjudication Board (DARAB)
After reviewing the Petition and its annexes, inclusive of the Court of Appeals' (CA) Decision 1 dated September 5, 2016 and Resolution 2 dated February 10, 2017 in CA-G.R. SP No. 132748, the Court resolves to DENY the Petition and AFFIRM the Decision and Resolution of the CA since the petitioners failed to sufficiently show that the CA committed any reversible error in the assailed Decision and Resolution as to warrant the exercise of this Court's discretionary appellate jurisdiction.
The CA affirmed the findings of facts and law in the Resolution dated July 30, 2013 issued by the Department of Agrarian Reform Adjudication Board (DARAB). Findings of fact of administrative agencies and quasi-judicial bodies, which have acquired expertise because their jurisdiction is confined to specific matters, are generally accorded not only respect, but finality when affirmed by the Court of Appeals. 3 Such findings deserve full respect and, without justifiable reason, ought not to be altered, modified, or reversed. 4 As found by the DARAB, petitioners' act of entering into a new tenancy agreement with the respondent landowners in 2002 indicated that they expressly recognized the latter's retention rights, and thus they are now estopped from not paying the lease rentals as agreed upon.
