NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated03 March 2021which reads as follows:
"A.C. No. 10974 (Ruderic C. Marzo, et al. v. Atty. Rafael A. Benedictos, Jr.). — The Court NOTES:
1. The letter dated October 16, 2020 1 of Director Randall C. Tabayoyong, Commission on Bar Discipline, Integrated Bar of the Philippines (IBP) in compliance with the June 17, 2020 Resolution, informing the Court that the Investigating Commissioner's report and recommendation and complainant's motion for reconsideration thereof were deliberated and acted upon by the Board of Governors (Board) on December 6, 2018 2 and June 27, 2020, 3 respectively; and
2. The IBP Board's: (a) December 6, 2018 Notice of Resolution which resolved to adopt the findings of fact and recommendation of the Investigating Commissioner to dismiss the complaint; and (b) June 27, 2020 Notice of Resolution No. CBD-2020-06-46 which denied complainant's motion for reconsideration dated August 27, 2019 there being no new reason and/or new argument adduced to reverse the December 6, 2018 Resolution of the Board; both transmitted by letter dated October 29, 2020 of Director Randall C. Tabayoyong, together with the records of the case.
Considering that the findings of fact, conclusions of law, and recommendation of the Investigating Commissioner in the attached July 20, 2018 Report and Recommendation, 4 as approved by the IBP Board, are supported by the evidence on record and by applicable laws, this Court ADOPTS and APPROVES these findings and recommendation and resolves to DISMISS the complaint against Atty. Rafael A. Benedictos, Jr.
Accordingly, the case is considered CLOSED and TERMINATED.
