NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedAugust 15, 2018which reads as follows:
"G.R. No. 239285 (Filinvest Land, Inc. v. Romeo Salvacion). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review, we resolve to DENY the petition for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error in its Decision dated November 23, 2017 and Resolution dated May 9, 2018.
We agree with the CA in ruling that when there is no ambiguity in the language of a contract, there is no room for construction, only compliance. Here, as found by the Office of the President (OP) and affirmed by the CA, petitioner admitted that the contract indicated a Redwood-SD house model but claimed that the price paid was actually for a Redwood-SF house model. 1 Unfortunately for petitioner however, evidence on record shows that the unit's data are consistent with the data in the price list, and nowhere in the records does it show that respondent was ever informed that he was paying for a Redwood-SF house model. Factual findings of administrative agencies which have acquired expertise in their fields are binding and conclusive upon the Court, considering further that the OP is presumed to be most competent in matters falling within its domain. 2 The principle applies reasonably in this case, especially when the findings of the administrative agencies and the quasi-judicial agency are consistent and have been passed upon and affirmed by the appellate court.
WHEREFORE, the petition is DENIED, and the Court of Appeals' Decision dated November 23, 2017 and Resolution dated May 9, 2018 in CA-G.R. SP No. 139780 are AFFIRMED.
