NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated June 23, 2021which reads as follows:
"G.R. No. 255125 (Eden O. Esquejo, Petitioner, vs. Filinvest Land, Inc., Loreta S. Santos and Josephine G. Yap, Respondents.) — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
This Petition for Review on Certiorari 1 under Rule 45 assails the Decision 2 dated 11 March 2020 and Resolution 3 dated 23 December 2020 of the Court of Appeals (CA) in CA-G.R. SP No. 156214. The CA held that the National Labor Relations Commission (NLRC) did not commit grave abuse of discretion in finding that petitioner Eden O. Esquejo (petitioner) was not constructively dismissed.
Upon review of the records, the Court resolves to DENY for failure of the petitioner to satisfactorily show any reversible error in the assailed CA Decision.
However, the Court finds it appropriate to modify said Decision as to include the legal interest at the rate of six percent (6%) per annum to be imposed upon the monetary award granted reckoned from the date of finality of the NLRC's Decision 4 dated 27 February 2018. 5
WHEREFORE, the Decision dated 11 March 2020 and Resolution dated 23 December 2020 of the Court of Appeals (CA) in CA-G.R. SP No. 156214 are AFFIRMED with MODIFICATION in that the monetary awards shall earn legal interest at the rate of six percent (6%) per annum from the date of finality of this Resolution until the amounts are fully paid.
