NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution datedJuly 18, 2022 which reads as follows:
"G.R. No. 256886 (East West Placement Center, Inc. v. Marcelito B. Alga). — This Court resolves a Petition for Review on Certiorari1 assailing the Court of Appeals-Cagayan de Oro City's (CA's) Decision 2 dated February 18, 2021 and Resolution 3 dated May 26, 2021 in CA-G.R. SP No. 09474-MIN, which found no grave abuse of discretion on the part of the National Labor Relations Commission (NLRC) and the labor arbiter in awarding money claims and attorney's fees to the respondent. TIADCc
Considering the allegations, issues, and arguments adduced in the Petition for Review on Certiorari, the Court finds no cogent reason to deviate from the CA, NLRC, and the labor arbiter's findings that the respondent was illegally dismissed and entitled to his unpaid salaries corresponding to the period of May 2017 to July 14, 2018, the unexpired portion of the employment contract, and attorney's fees. However, a legal interest of 6% per annum on the monetary awards must be imposed consistent with prevailing jurisprudence. 4
FOR THESE REASONS, the Petition is DENIED. The Court of Appeals-Cagayan de Oro City's Decision dated February 18, 2021 and Resolution dated May 26, 2021 in CA-G.R. SP No. 09474-MIN are AFFIRMED with MODIFICATION in that the monetary awards shall earn rate of 6% per annum from the date of finality of this Resolution until full payment.
