Please take notice that the Court, First Division, issued a Resolution datedJune 4, 2018which reads as follows:
"G.R. No. 236909 (Virginia Dizon, Elsie Emerald Gallego and Ernesto Gallego v. Roberto Labajo, Amadeo M. Cabacoy, Victor Benolerao and Reynaldo Llaguno). — The motion for extension of time to file petition for review on certiorari filed by the petitioners is GRANTED. acEHCD
After review of the records, the Court resolves to DENY the petition for failure of petitioners to show any reversible error in the assailed ruling. The Court of Appeals correctly found that petitioner Virginia Dizon's re-acquisition of the land was not a supervening event that would render the execution of the October 13, 2010 Decision of the Department of Agrarian Reform Adjudication Board's as unjust and equitable. Further, since it does not appear on record that a written notice of sale of the land was sent to the respondents, there is no prescription to speak of. Respondents' right of redemption subsists.
WHEREFORE, premises considered, the petition is DENIED. The Decision dated May 5, 2017 and the Resolution dated November 28, 2017 of the Court of Appeals in CA-G.R. SP No. 06769-MIN are hereby AFFIRMED.
The Cash Collection and Disbursement Division is hereby DIRECTED to RETURN to the petitioners the excess payment for the legal fees in the amount of P470.00 under O.R. No. 0202462-SC-EP dated February 13, 2018.
