Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 05 November 2018 which reads as follows:
"G.R. No. 241473 — Mandie H. Labajo versus YHMD Int'l. Manpower Services, Inc. and Ma. Teresa S. Dawud, as President (Local Agency) and Saudi Manpower Co. (SMASCO) (Principal Abroad)
After reviewing the Petition and its annexes, including the Decision 1 dated July 6, 2018 of the Court of Appeals (CA), Special Twenty-Third Division in CA-G.R. SP No. 08375-MIN, the Court RESOLVES to DENY the instant Petition and AFFIRM the said ruling of the CA.
The CA committed no reversible error in affirming the Resolution 2 dated June 20, 2017 of the National Labor Relations Commission which, in turn, likewise affirmed the Decision 3 dated March 2, 2017 of the Labor Arbiter. Petitioner Mandie H. Labajo failed to prove by substantial evidence that he was illegally dismissed. Instead, records show that he voluntarily resigned from employment and executed, freely and without duress, a Release, Waiver and Quitclaim in favor of respondents. He had likewise received a full settlement of all his money claims against respondents.
