NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution datedJuly 8, 2019, which reads as follows:
"G.R. No. 244442 (NICANOR DE RAMA y GUEVARRA, petitioner v. PEOPLE OF THE PHILIPPINES, respondent). — After a judicious study of the case, this Court resolves to deny the Petition for Review on Certiorari1 for petitioner's failure to show that the Court of Appeals committed any reversible error in its assailed May 17, 2018 Decision. 2 However, in light of People v. Tulagan, 3 this Court modifies the penalty imposed, and increases the awards of civil indemnity, moral damages, and exemplary damages to P50,000.00 each. HTcADC
WHEREFORE, the May 17, 2018 Decision of the Court of Appeals in CA-G.R. CR No. 39992 is AFFIRMED with MODIFICATION. Petitioner Nicanor De Rama y Guevarra is found GUILTY beyond reasonable doubt of the crime of violation of Section 5 (b) of Republic Act No. 7610. He is sentenced to serve the penalty of imprisonment with a minimum period of twelve (12) years and one (1) day of reclusion temporal minimum to a maximum period of seventeen (17) years, four (4) months, and one (1) day of reclusion temporal medium, and to pay the amounts of: (1) Fifty Thousand Pesos (P50,000.00) as civil indemnity; (2) Fifty Thousand Pesos (P50,000.00) as moral damages; and (3) Fifty Thousand Pesos (P50,000.00) as exemplary damages. All damages awarded shall be subject to interest at the rate of six percent (6%) per annum from the finality of this Resolution until full payment.
