NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated August 10, 2015 which reads as follows:
"G.R. No. 215339(People of the Philippines v. Anthony Guevarra y Dionisio). — The Office of the Solicitor General's manifestation and motion (in lieu of supplemental brief) and the accused-appellant's manifestation (in lieu of supplemental brief), both in compliance with the Resolution dated February 4, 2015, are NOTED.
After a judicious review of the records, the Court resolves to DISMISS the appeal for failure to show that the Court of Appeals (CA) committed any reversible error in upholding the conviction of accused-appellant Anthony Guevarra y Dionisio of the crime of Rape, as defined and penalized under Paragraph 1, Article 266-A of the Revised Penal Code (RPC). However, in order to conform with recent jurisprudence, 1 the Court deems it proper to reduce the amount of civil indemnity and moral damages from P75,000.00 to P50,000.00.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the August 19, 2014 Decision 2 of the CA in CA-G.R. CR HC No. 06302 and AFFIRMS said Decision finding accused-appellant Anthony Guevarra y Dionisio GUILTY beyond reasonable doubt of the crime of Rape, as defined and penalized under Paragraph 1, Article 266-A of the RPC, with MODIFICATION as to the amount of damages, sentencing him to suffer the penalty of reclusion perpetua without eligibility for parole, and ordering him to pay AAA the following amounts: (a) P50,000.00 as civil indemnity; (b) P50,000.00 as moral damages; and (c) P30,000.00 as exemplary damages, with legal interest of the rate of six percent (6%) per annum to be reckoned from the finality of this Resolution until fully payment.
