FIRST DIVISION
[UDK-15140. October 8, 2014.]
CK BUILDERS/CHRISTOPHER KING, petitioners, vs. ROEL DINOPOL, LEONILO NIÑO, ROBERTO PRODEL, CARLOS VILLANUEVA, JORALP R. WATIMAR, PEMAR RUBO, RUBEN VILLANUEVA, MELFRAN RELATIVO, SONNY REGODOS, RODELIO SANCHEZ, GRECERIO BORRES, LINDO HUCOR, AND JEFFREY TEVES, respondents.
NOTICE
Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated October 8, 2014which reads as follows:
"UDK-15140 (CK Builders/Christopher King v. Roel Dinopol, Leonilo Niño, Roberto Prodel, Carlos Villanueva, Joralp R. Watimar, Pemar Rubo, Ruben Villanueva, Melfran Relativo, Sonny Regodos, Rodelio Sanchez, Grecerio Borres, Lindo Hucor, and Jeffrey Teves). — ISDCaT
After a judicious review of the records, the Court resolves to DENY the petition and AFFIRM the July 31, 2012 1 and June 13, 2014 2 Resolutions of the Court of Appeals (CA) in CA-G.R. SP No. 06886 for failure of CK Builders/Christopher King (petitioners) to sufficiently show that the CA committed any reversible error in outrightly dismissing their petition due to procedural infirmities.
As correctly ruled by the CA, petitioners failed to present any cogent reason to exempt them from the effects of their failure to comply with the Rules of Court. While it is true that litigation is not a game of technicalities, it is equally true that every case must be prosecuted in accordance with the prescribed procedure. 3 Fundamental is the rule that save for the most persuasive of reasons, strict compliance with rules of procedure is enjoined to facilitate the orderly and speedy administration of justice, 4 as in this case. ISTHED
SO ORDERED."
Very truly yours,
(SGD.) EDGAR O. ARICHETADivision Clerk of Court
