NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated September 16, 2013, which reads as follows:
"G.R. No. 208279 (Cavite State University Development Cooperative, et al. v. Florence R. Pallera). — The Court resolves to:
(1) NOTE the entry of appearance as counsel for petitioners, filed by Atty. Cecilio D. Duka, and GRANT his request that he be furnished copies of all processes, orders and resolution of this Court at Unit 421 W. Sofia Bellevue Condominium, No. 11 Capitol Hills Drive, Diliman, Quezon City;
(2) EXCLUDE the Court of Appeals as respondent from the title of this case pursuant to Section 4 (a), Rule 45 of the 1997 Rules of Civil Procedure; and
(3) DIRECT the parties or their counsels to INDICATE their contact details in all papers and pleadings to be filed with this Court pursuant to A.M. No. 07-6-5-SC (En Banc Resolution dated July 10, 2007). EHcaDT
The Court, after a review of the records, resolves to DENY the petition and AFFIRM the Decision and Resolution dated November 28, 2012 and July 8, 2013, respectively, of the Court of Appeals (CA) in CA-G.R. SP 112659 for (a) failure of the petitioners to show any reversible error committed by the CA in ruling that the respondent was a regular employee and that she was illegally dismissed. On the contrary, the CA Decision is consistent with the Court's ruling in Tamson's Enterprises, Inc. v. Court of Appeals; 1 (b) failure of the petitioners to attach clearly legible duplicate original or certified true copy of the assailed Decision and Resolution pursuant to Section 4, Rule 45; and (c) failure to submit a proper affidavit of service under Section 13, Rule 13 of the Rules of Court, as the affidavit of service was notarized prior to the actual date of service of copies of petition upon the CA and respondent.
