Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution datedAugust 15, 2018which reads as follows:
"G.R. No. 239425 (Jose Archerish Calanza v. Philippine Transmarine Carriers, Inc., Komaya Shipping Company (PTE) Ltd., and Capt. Elias Parreno). — The petitioner's motion for an extension of thirty (30) days within which to file a petition for review on certiorari is GRANTED, counted from the expiration of the reglementary period.
After review, the Court resolves to DENY this petition for review on certiorari for failure to sufficiently show that the Court of Appeals (CA) committed any reversible error.
The Labor Arbiter, National Labor Relations Commission, and the CA all found that petitioner Jose Archerish Calanza voluntarily terminated his contract with respondents. Petitioner insisted on being sent back to the Philippines despite his superior's explanation of the consequences of contract pre-termination. They likewise concluded that petitioner was not repatriated for medical reasons because the doctor whom petitioner consulted during the voyage cleared him fit to work. Lastly, petitioner failed to establish that he followed the procedure for claiming disability benefits under Section 20-A of the Philippine Overseas Employment Administration-Standard Employment Contract. cHDAIS
The Court finds no reason to disturb these uniform findings.
WHEREFORE, the petition is DENIED. The assailed Decision dated February 28, 2018 and Resolution dated May 23, 2018 of the Court of Appeals in CA-G.R. SP No. 151167 are AFFIRMED.
