NOTICE
Sirs/Mesdames :
Please take notice that the Court, Second Division, issued a Resolution dated 01 February 2021which reads as follows:
"G.R. No. 253386 (Philippine Transmarine Carriers, Inc. and/or Marin Shipmanagement Limited v. Aramis M. Orsolino). — This is a Petition for Review on Certiorari1 under Rule 45 assailing the Court of Appeals' (CA) Decision 2 dated January 28, 2020 and Resolution dated August 27, 2020 in CA-G.R. SP No. 155542 which affirmed the Panel of Voluntary Arbitrators' (PVA) award of total and permanent disability benefits to a seafarer.
Considering the allegations, issues, and arguments adduced in the petition for review on certiorari, the Court finds no cogent reason to deviate from the CA and the PVA's findings that respondent Aramis M. Orsolino's (respondent) illness is work-related and compensable. However, the interest rate on the monetary awards must be reduced from twelve percent (12%) to six percent (6%) per annum consistent with prevailing jurisprudence. 3
FOR THESE REASONS, the petition is DENIED. The Court of Appeals' Decision dated January 28, 2020 and Resolution dated August 27, 2020 in CA-G.R. SP No. 155542 are AFFIRMED with MODIFICATION in that the interest rate on the awards of disability benefits and attorney's fees is REDUCED from twelve percent (12%) to six percent (6%) per annum.
