Sirs/Mesdames :
Please take notice that the Court, First Division, issued a Resolution dated March 13, 2019which reads as follows:
"G.R. No. 241145 (Bright Homes & Realty Corporation v. First Centennial International Trading Corporation, Jeffrey D. Sales and Registry of Deeds of Meycauayan, Bulacan)
After review of the records, the Court resolves to DENY the petition for failure to sufficiently show that the Court of Appeals committed any reversible error in its May 22, 2018 Decision 1 and August 1, 2018 Resolution, 2 as to warrant the exercise of the Court's appellate jurisdiction.
Petitioner failed to establish a clear and unmistakable right as to necessitate the issuance of a writ of preliminary injunction. It failed to present proof that it stands to suffer from serious and irreparable damage if First Centennial International Trading Corporation (FCITC), the Registry of Deeds of Meycauayan, and Sheriff Jeffrey D. Sales are not restrained of enjoined from enforcing the September 29, 2015 execution sale, including the final conveyance and consolidation of title to the subject properties in favor of FCITC. In the event that a favorable judgment be rendered, petitioner Bright Homes & Realty Corporation would have adequate relief through reimbursement of the amount it had paid and/or payment of damages.
WHEREFORE, the petition is DENIED. The May 22, 2018 Decision and August 1, 2018 Resolution of the Court of Appeals in CA-G.R. SP No. 154000 are AFFIRMED.
Jeffrey D. Sales, Branch Sheriff of the Regional Trial Court, Branch 274, Parañaque City, and the Registry of Deeds of Meycauayan, Bulacan, are DELETED as party respondents in this case pursuant to Sec. 4, Rule 45, 1997 Rules of Civil Procedure, as amended.
The petitioner's manifestation of compliance with the Resolution dated November 21, 2018, stating that it has paid the total amount of P1,300.00 for the prayer for issuance of a writ of preliminary injunction and deposit for sheriff's fee on February 18, 2019 is NOTED. CAIHTE
