NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated January 21, 2019, which reads as follows:
"G.R. No. 241723 (Orlando Bañagale y Luistro v. People of the Philippines). — Considering the allegations, issues and arguments adduced in the petition for review on certiorari, as well as the respondent's comment thereon, the Court Resolved to DENY the petition for failure of the petitioner to sufficiently show that the respondent court had committed any reversible error in its questioned decision.
WHEREFORE, PREMISES CONSIDERED, the Court AFFIRMS the Decision of the Court of Appeals in CA-G.R. CR No. 37811, dated November 23, 2017, WITH MODIFICATION that the petitioner be penalized for acts of lasciviousness under Article 336 of the Revised Penal Code, as amended, in relation to Section 5 (b), Article III of R.A. No. 7610, pursuant to People v. Caoili. 1 He is sentenced to suffer the indeterminate imprisonment of twelve (12) years and one (1) day of reclusion temporal in its minimum period, as minimum, to fifteen (15) years, six (6) months, and twenty-one (21) days of reclusion temporal in its medium period, as maximum, and pay the victim P50,000.00 as civil damages, P50,000.00 as moral damages and P50,000.00 as exemplary damages, subject to interest at the rate of six percent (6%) per annum from the date of finality of this Resolution until fully paid.
