Please take notice that the Court, Third Division, issued a Resolution datedOctober 15, 2018, which reads as follows:
"A.C. No. 10123 (Vitaliano N. Aguirre II v. Atty. Nelson A. Clemente and Atty. Gervacio B. Ortiz, Jr.). — For resolution is a Complaint for Disbarment 1 against respondents Atty. Nelson A. Clemente and Atty. Gervacio B. Ortiz, Jr. before the Commission on Bar Discipline, Integrated Bar of the Philippines (IBP). ScaCEH
In his Report and Recommendation dated March 16, 2011, the Investigating Commissioner, Atty. Eldrid C. Antiquiera, recommended the dismissal of the complaint finding that the complainant failed to substantiate his allegations. In Resolution No. XX-2012-273 dated July 21, 2012, the Board of Governors of the IBP adopted and approved said Report and Recommendation dismissing the case due to lack of merit.
Finding the recommendation of the IBP to be fully supported by the evidence on record and applicable laws, the Court RESOLVES to DISMISS the case against Atty. Nelson A. Clemente and Atty. Gervacio B. Ortiz, Jr. and consider the same as CLOSED and TERMINATED. ACTIHa
