In the interest of service and consistent with the supervisory authority of the Secretary of Justice over the National Prosecution Service (NPS), the following uniform rules of procedure on the disposition of petition for review cases assigned to the Divisions in the NPS, which was formulated and agreed upon by the Division Heads in a meeting held on January 21, 2010, is hereby approved for strict compliance, subject to periodical evaluation: DTCSHA
I. Keeping of logbook/index cards where petition for review cases assigned to the division will be recorded within five (5) days from receipt of assignment.
II. Assignment/distribution of cases to Division Members will be done within five (5) days after recording in the logbook/index cards. Equal distribution of assignment shall be observed.
III. Actions of Division Members and Division Heads:
A. The Division Members shall resolve the petition for review cases assigned to them within thirty (30) days from receipt thereof.
B. The Division Heads shall have the same period of thirty (30) days from submission of Division Members within which to review their prepared resolutions before forwarding the same to the supervising Assistant Chief State Prosecutors.
IV. The Division Heads shall adopt standard evaluation checklist to determine compliance with requirements for filing petitions for review and templates on minute resolutions for outright dismissal of petitions on specific grounds provided in the rules governing appeals before the Department of Justice.
This Order takes effect immediately and shall remain in force until further orders. IDTSaC
