SENATE RESOLUTION NO. 107
RESOLUTION CONCURRING IN THE RATIFICATION OF THE TREATY ON EXTRADITION BETWEEN THE REPUBLIC OF THE PHILIPPINES AND THE PEOPLE'S REPUBLIC OF CHINA
WHEREAS, the Treaty on Extradition Between the Republic of the Philippines and the People's Republic of China was signed in Beijing on 30 October 2001;
WHEREAS, the RP-China Extradition Treaty, consisting of twenty-one (21) Articles, aims to provide for more effective cooperation between the Parties in the repression of crime on the basis of mutual respect for sovereignty and equality and of mutual benefit;
WHEREAS, under the RP-China Extradition Treaty, the Parties agree to extradite to each other any person who is found in the territory of the requested Party and who is wanted by the requesting Party for prosecution or for the imposition or enforcement of a sentence in respect of an offense described in Article 2 (Extraditable Offenses) of the Treaty;
WHEREAS, the Department of Justice (DOJ) strongly recommends the ratification of the Treaty;
WHEREAS, Article 21, Paragraph 1 of the RP-China Extradition Treaty provides that it shall enter into force thirty (30) days after the date of the exchange of the instruments of ratification;
WHEREAS, pursuant to Section 21, Article VII of the 1987 Philippine Constitution, "No treaty or international agreement shall be valid and effective unless concurred in by at least two-thirds of all the Members of the Senate": Now, therefore, be it
Resolved, That the Senate of the Philippines concur, as it hereby concurs, in the ratification of the Treaty on Extradition Between the Republic of the Philippines and the People's Republic of China.
