Suspension of Implementation of Out of Line Operation as Mode of Colorum Operations

LTFRB MEMORANDUM CIRCULAR NO. 009-14

The Joint Administrative Order No. 2014-01 provides that the LTFRB shall hear and decide all franchise violations, such as Public Utility Vehicles ("PUVs") engaging in out-of-line operations defined and penalized under PART IV, Item 1, paragraph b, which provides:
"1. Colorum Violation — . . .
a.
b. A PUV operating outside of its approved route or area without a prior permit from the Board or outside the exceptions provided under existing memorandum circulars or commonly known as out of line operations." IECAaD
In order to efficiently enforce and judiciously adjudicate out-of-line violations, the Board will conduct a rationalization of current authorized route structures both as to route description and the number of authorized units therein within a period of One Hundred Twenty (120) days from the effectivity of JAO No. 2014-01 on JUNE 19, 2014 or up to OCTOBER 17, 2014. The Board shall promulgate implementing guidelines to govern the said rationalization.
Pending the conduct of such rationalization, enforcement operations against out-of-line violations defined and penalized under PART IV, Item 1, paragraph b of JAO No. 2014-01 shall be TEMPORARILY SUSPENDED.
This Memorandum Circular shall take effect immediately after its publication in a newspaper of general circulation in Philippines pursuant to the New Civil Code. Three (3) copies hereof shall be furnished the UP Law Center in accordance with Presidential Memorandum Circular No. 11 dated October 9, 1992. DEaCSA
