MMDA REGULATION NO. 001-12
STRICTLY IMPLEMENTING ANTI-JAYWALKING AND FURTHER AMENDING ORDINANCE NO. 1, SERIES OF 1995 ENTITLED "ANTI-JAYWALKING IN METROPOLITAN MANILA AND PROVIDING PENALTIES THEREFOR" AS AMENDED BY MMDA REGULATION NO. 99-013, SERIES OF 1999
WHEREAS, the Metro Manila Council enacted an Ordinance No. 1, Series of 1995 entitled "Anti-Jaywalking in Metropolitan Manila and Providing Penalties Therefor"; HTCESI
WHEREAS, to impose stiffer penalties due to blatant violation of the Ordinance by the pedestrians, the Metro Manila Council passed MMDA Regulation No. 99-013, Series of 1999 entitled "Amending MMDA Ordinance No. 1, Series of 1995 entitled Anti-Jaywalking in Metropolitan Manila and Providing Penalties Therefor";
WHEREAS, the MMDA in its desire to improve the traffic flow, constructed footbridges, pedestrian overpasses/underpasses and installed marked cross-walk or pedestrian crossing all over the metropolis;
WHEREAS, despite the existence of the said footbridges and pedestrian overpasses/underpasses, the pedestrians intentionally violate the Anti-Jaywalking Ordinance;
WHEREAS, jaywalking along the streets and thoroughfares is the main contributory factor to the traffic problems and road accidents in Metro Manila;
WHEREAS, the Council, in session duly assembled, recognizes the need to strictly implement the Anti-Jaywalking Ordinance and further amend Ordinance No. 1, Series of 1995 as amended by MMDA Regulation No. 99-013, Series of 1999, to ease the traffic congestion and mitigate traffic accidents involving pedestrians in Metro Manila.
NOW, THEREFORE, pursuant to Sec. 6 of RA 7924, this Amendatory Regulation is hereby promulgated and adopted by the Metro Manila Council, that:
SECTION 1. Section 1 is hereby amended by adding item (e), which provides:
(e) Where the pedestrian shall leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impractical to yield.
SECTION 4. Section 4 is hereby amended to read as follows:
Section 4. Penalty. — Violation of this Regulation shall be penalized by any of the following fine and/or penalties: ACIDSc
4.1 Two Hundred Pesos (P200.00) which may paid outright by the apprehended violator at the place of apprehension and upon issuance of a Pedestrian Violation Receipt (PVR). For this purpose, the apprehended jaywalking violator who fails to pay outright the fine for such violation shall be given seven (7) days from date of apprehension to settle the same at the MMDA Redemption Center, otherwise appropriate legal action shall be filed in the proper court.
4.2 MMDA Community Service for not more than one (1) day which will consist of Disaster, Flood Preparedness and Public Safety training.

SECTION 6. Section 4 is hereby amended to read as follows:
Section 6. Creation of the Anti-Jaywalking Task Force Under the Traffic Discipline Office. — For purposes of this Regulation, there is hereby created an Anti-Jaywalking Task Force under the Traffic Discipline Office (TDO). MMDA traffic enforcers, and deputized law enforcers shall be authorized to apprehend violators of jaywalking. Other law enforcers may be deputized later in accordance with paragraph (f), Section 5 of R.A. No. 7924.
RESOLVED FURTHER, that this Regulation, Ordinance No. 1, Series of 1995, as amended by MMDA Regulation No. 99-013, Series of 1999, shall be a supplemental to the existing Anti-Jaywalking Ordinances of the cities and municipality of Metropolitan Manila.
RESOLVED FINALLY, that in order to effectively carry out and achieve the goals of this Regulation, the MMDA Chairman is hereby authorized to issue Guidelines as may be necessary in its study, implementation, and enforcement, subject to review of the Council.
This Regulation shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation in Metro Manila.
