| SUBJECT | : | Strict Compliance of PD No. 1079 (Revising and Consolidating All Laws and Decrees Regulating the Publication of Judicial Notices, Advertisements for Public Biddings, Notices of Auction Sales and Other Similar Notices) |
P.D. No. 1079 was circularized to all courts as SUPERVISORY CIRCULAR NO. 4 dated March 8, 1977 and CIRCULAR NO. 16 dated July 18, 1979.
However, despite the explicit directives of the decree and the continuous reminders of this Court, persistent reports of blatant violations by a majority of the newspapers in the entire country besiege this Office.
Hence, the Court in its resolution En Banc dated August 6, 1996, DIRECTS all Executive Judges and Clerks of Court to order all newspapers in their locality participating in the raffle of legal and judicial notices to comply strictly with the provisions of P.D. No. 1079, specially Section 4 thereof, under pain of being excluded from said raffle if found violating the same and REMINDS the: (1) sheriffs to strictly comply with the provisions of said Presidential Decree and (2) Executive Judges and Clerks of Court of the provisions of Section 6 of the same P.D. No. 1079, as failure on their part to strictly enforce the provisions of this decree shall be dealt with administratively. TEDHaA
