DAR MEMORANDUM CIRCULAR NO. 02-16

Pursuant to the 1987 Constitution which states that "The right of the people to information on matters of public concern shall be recognized. Access to official records, and to documents, and papers pertaining to official acts, transactions, or decisions, as well as to government research data used as basis for policy development, shall be afforded the citizen, subject to limitations as may be provided by law" and Republic Act (R.A.) No. 6713 which provides that "all public officials and employees are obligated to, among others, make documents accessible and readily available to the public," the following rules are hereby issued:
1. The general public shall have access to signed and officially released ALI, Land Use Cases, and DARAB/PARAD Decisions without need for prior clearance.
2. The general public shall have access to the records of ALI, Land Use Cases, and DARAB/PARAD Decisions without need for prior clearance once the Decision to the said case has been certified as final and executory.
If the case is still pending or the Decision is not yet final and executory, access to such records shall be subject to Memorandum Circular No. 07, Series of 2011.
3. Any request for certified true copies may be granted subject to the abovementioned rules on access and the applicable fees under Memorandum Circular No. 02, Series of 2011, as clarified.
4. In all of the above cases, it is understood that during the viewing and/or copying process, extraordinary diligence shall be exercised by the records officer or such pertinent DAR official or employee in ensuring that the integrity of the records will be maintained. CAIHTE
The Public Assistance and Media Relations Service (PAMRS) and Agrarian Reform Capacity Development Service (ARCDS) are hereby given twenty (20) days to jointly design a public notice regarding this Memorandum Circular and immediately transmit the same to the Records Division of the DAR Central Office and all DAR Regional Offices which must print and post it within their vicinity no later than 30 April 2016.
