The Supreme Court En Banc has issued a Resolution dated February 16, 2010 in A.M. No. 08-8-7-SC (Re: Rule of Procedure for Small Claims Cases), copy of which is attached for your information and guidance.
Henceforth, all actions filed before the Metropolitan Trial Courts, Municipal Trial Courts in Cities, Municipal Trial Courts and Municipal Circuit Trial Courts for payment of money where the value of the claim does not exceed One Hundred Thousand Pesos (P100,000.00) exclusive of interest and costs, from March 18, 2010 onwards shall be governed by the Rule of Procedure for Small Claims Cases as amended.
In connection therewith, small claims cases filed on the aforesaid date in multiple sala court stations shall be raffled among the branches thereat. In case there are pilot courts for small claims cases in the station, the pilot courts shall not be included in the raffle until such time that the number of small claims cases raffled to the branch has reached the same number of small claims cases assigned to the pilot courts. Thereafter, the small claims cases shall be equitably distributed among the branches in the station.
