EXECUTIVE ORDER NO. 205
REVOKING EXECUTIVE ORDER NO. 427 (s. 2005) AND RETURNING THE INFRASTRUCTURE FACILITIES COVERED THEREIN TO THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS FOR PURPOSES OF REPAIR, MAINTENANCE AND MANAGEMENT
WHEREAS, Executive Order (EO) No. 427 (s. 2005) mandated the turn over of the repair, maintenance and management of three (3) government-owned and Department of Public Works and Highways (DPWH)-administered facilities, namely: United Nations Avenue (Sta. 8 + 291 — Sta. 10 + 639, net length of 2.348 km.), AC Cortes Avenue (Sta. 7 + 196 — Sta. 9 + 507, net length of 2.311 km.), and Marcelo Fernan Bridge Access Roads to and from the Mini park (Mandaue Side) (Sta. 10 + 119 — Sta. 10 + 955 including the Mini park), from the DPWH to the City of Mandaue, subject to the execution of the requisite deed of conveyance;
WHEREAS, up to now, no deed of conveyance has been executed between the DPWH and the City of Mandaue resulting in the ambiguity over the administration and lack of sufficient repair and maintenance over these facilities;
WHEREAS, the City of Mandaue, through its Sangguniang Panlungsod Resolution Nos. 13-555-2015 and 13-754-2015, requested for the return of the facilities to the DPWH; and
WHEREAS, there is further need to determine the proper authority over the facilities in order to enable the commencement of vital public infrastructures that will improve the transportation and traffic condition in the concerned areas.
NOW, THEREFORE, I, BENIGNO S. AQUINO III, President of the Philippines, by virtue of the powers vested in me by law, do order:
SECTION 1. Revocation of EO 427. — Executive Order No. 427 (s. 2005) is hereby revoked. The repair, maintenance and management of the facilities subject of the said EO are hereby returned to the DPWH.
SECTION 2. Repeal. — All orders, proclamations, rules, regulations, or parts thereof, which are inconsistent with this Order are hereby repealed or modified accordingly.
SECTION 3. Effectivity. — This Order shall take effect immediately upon publication.
