LTO Administrative Order No. ACL-2009-019, issued on November 13, 2009, revises the penalties for violations related to mobile air conditioning systems and refrigerants under the NCPP for motor vehicles. The penalties escalate from a fine of Php 1,000 for a first offense to Php 5,000 for a third offense, which also requires attendance at a seminar on ozone layer protection. A third offense within a year of the first results in a one-year suspension of vehicle registration, while a fourth offense leads to cancellation of the vehicle's registration. This order supersedes any conflicting regulations and will take effect 15 days after publication.

LTO ADMINISTRATIVE ORDER NO. ACL-2009-019

SUBJECT : Revised Schedule of Penalties in the Enforcement of Regulations on the Implementation of the NCPP on Motor Vehicles

 

Pursuant to the provisions of Joint Administrative Order No. 3, series of 2006, re: Enforcement of Regulation on the Implementation of the NCPP on Motor Vehicles under the Revised Chemical Control Order for Ozone Depleting Substances (DENR Administrative Order No. 2004-08, Series of 2004), and implemented through Memorandum Circular No. 710-2006 dated 17 April 2006, the schedule of penalties under section 9 thereof are hereby revised, to be read as follows:

An operator/owner of apprehended vehicle found to have violated the rules and regulations on mobile aircon system and refrigerant type shall suffer the following penalties:

1. First offense — a fine in the amount of one thousand pesos (Php1,000.00);

2. Second offense — a fine in the amount of three thousand pesos (Php3,000.00);

3. Third offense — a fine in the amount of five thousand pesos (Php5,000.00) and an offender must undergo a seminar on the "Protection of Ozone Layer" to be conducted by the Philippine Ozone Desk — NCPP-PMU of the EMB (Environmental Management Bureau)/EMB Regional Offices.

 In case the 3rd offense is committed within a year from the commission of the first offense, an additional penalty of suspension of the motor vehicle registration for a period of one (1) year shall be imposed; and

4. Fourth Offense — CANCELLATION of the registration of the motor vehicle. HTIEaS

All circulars, orders, memoranda, rules and regulations or issuances in conflict herewith are deemed repealed or modified accordingly.

This order shall take effect fifteen (15) days after receipt of copies by the Office of the National Administrative Register (ONAR) U.P. Law Center, Diliman, Quezon City, and publication thereof in two (2) newspapers of general nationwide circulation.
