REVISED RULES GOVERNING THE MANAGEMENT OF THE OFFICE OF THE POLICE ATTACHÉ AT THE PHILIPPINE FOREIGN SERVICE POSTS

1. References:

a. Republic Act (RA) No. 7157, The Philippine Foreign Service Act of 1991 approved on September 19, 1991;

b. Executive Order No. 156, Amending EO 461 and Adjusting the Overseas, Living Quarters, Representation and Family Allowance of Foreign Service Personnel signed on December 23, 2013;

c. Department of Foreign Affairs (DFA) Order No 19A-95, Regulations of the DFA with regard to the implementation of the provisions of RA No. 7157 and other relevant laws, orders, circulars and issuances dated April 28, 1995;

d. DFA Department Circular No. 01-11, Actual Cost of Shipment of Personal Effects dated January 31, 2011;

e. Joint Circular No. 01-2015, Guidelines on the Assignment of Representatives of Partner Agencies to the Philippine Foreign Service Post signed on June 4, 2015;

l. CPNP approved memorandum dated November 7, 2014 re Rank and Minimum Length of Service Qualifications for Administrative Assistant (AA).

2. Rationale:

The management of the Office of Police Attaché (OPA) is a function given to the Directorate for Intelligence as provided in Sec 5 (2), Rule II, Police Manual for PNP Members approved by NAPOLCOM Resolution No. 93-023 dated 27 May 1993 and Memorandum Circular (MC) No. 2003-003 "Rules Governing Selection, Appointment, Duties, Compensation and Supervision of Personnel of the Office of Police Attaché at Philippine Diplomatic Posts" signed by PDG Hermogenes E. Ebdane Jr. dated May 2003. This function is in consonance with the main purpose of the creation of OPA post which is to gather foreign intelligence through joint cooperation and coordination with foreign counterparts.

Lately, the approval and implementation of new policies by the Department of Foreign Affairs, the National Police Commission, and the Philippine National Police concerning the management of OPA personnel deemed it necessary to amend the existing memorandum circular not only to harmonize the MC with the new policies and Administrative Order but also to make it receptive to the present situation. 3. Situation:

The growing complexities of crimes and its borderless commissions create an emerging threat to security and add burden to the function of the police force. This calls for not only building police capacity through training or enhancing and increasing operations but most importantly intensifying intelligence gathering. The role of intelligence in addressing problems on illegal drug proliferation, human trafficking, terrorism, and other transnational crimes cannot be overemphasized. Valuable intelligence can be gathered in collaboration with other police organizations from the Asian Region, Middle East, America and Europe through the effective management of the Office of Police Attachés by the Directorate for Intelligence.

4. Purpose:

This Circular prescribes the policies, rules and regulations governing the selection, appointment, duties, compensation, control and supervision of the personnel of the Office of the Police Attaché (OPA) at the Philippine Foreign Service Posts to ensure that the objectives of the OPA are achieved.

5. Definition of Terms:

The following definition of terms shall be used in interpreting this Circular:

a. Administrative Assistant (AA) — a senior Police Non-Commissioned Officer (PNCO) who assists the Police Attaché (PA) and Assistant Police Attaché (APA) in the performance of official function.

b. Assistant Police Attaché (APA) — a Police Commissioned Officer (PCO) who assists the PA, in the performance of official function.

c. DI Selection Board (Board) — refers to the body composed of DI senior officers which conducts the selection and nomination of the police officers as candidates for deployment to OPA.

d. DI Selection Board Secretariat (Secretariat) — a body composed of personnel assigned at the Attaché Management Section of Foreign Liaison Division, Directorate for Intelligence that assists the Board in the selection of OPA personnel.

e. Home Office (HO) — refers to the National Headquarters, Philippine National Police (PNP).

f. Home Office Consultation — is a directive from Chief, Philippine National Police (C, PNP) or The Director for Intelligence (TDI) to PA to report to HO to render specific compliance/s.

g. Nominee — applicant who is nominated and endorsed by the Board to be projected as PA, APA and AA.

h. Office of the Police Attaché (OPA) — an overseas office under the immediate administrative control and supervision of the Head of Post and at the same time under the operational control and supervision of the PNP through the Directorate for Intelligence.

i. Police Attaché (PA) — a senior Police Commissioned Officer (PCO) with duties and functions of a Police Officer and a Diplomat at the same time. He may also be called as Police Liaison Officer (PLO), Police Liaison Attaché (PLA) or as the case may be depending on the accreditation by the host country.

j. Non-Resident Attaché (NRA) — refers to the status of a Police Attaché accredited as Police Attaché in a particular country aside from his original country of assignment.

6. Policies:

a. The PNP shall select and nominate the most qualified PNP personnel to man the OPA posts. No personnel shall be posted unless he/she possesses the basic qualifications set forth in this Memorandum Circular.

b. The PNP, through the Directorate for Intelligence, is empowered to supervise and control the PNP foreign intelligence efforts through the effective management of the Police Attaché System.

c. The Tour of Duty (TOD) of OPA personnel shall be for a maximum of three years commencing on the date of his arrival at the post.

d. The C, PNP may recommend the recall of OPA personnel for unsatisfactory performance or violation of existing laws as certified by the Head of Post or upon recommendation by the Board.

e. The PNP promotes gender equality, advances equal access and places no restriction on the eligibility of women to be deployed in the OPA posts.

f. In consonance with the principle of country-team approach that is observed in the Philippine Foreign Service Post, OPA personnel shall at all times maintain harmonious relations and provide necessary assistance to other members of the Post within the limits of their professional competence and resources.

g. The privileges and immunities as provided in the provisions of the Vienna Convention on Diplomatic and Consular Relations which apply to Foreign Service Officers and staff shall, subject to conditions of the host country, apply to OPA personnel.

h. OPA personnel with assimilated rank of Foreign Service Officer shall rank immediately after the most junior Foreign Service Officer at Post. Staff Officer with assimilated rank of Foreign Service Staff Officer shall rank immediately after the most junior Foreign Service Staff Officer at Post.

7. Guidelines:

a. Basic Qualifications

Upon application, the candidate must possess the following:

1) Police Attaché (PA)

a) Rank OPA Posts shall be occupied by officers with the
    rank of Police Senior Superintendent. OPA
    Washington DC (WDC) requires an entry level for
    PCSUPT pursuant to NAPOLCOM Resolution No.
    2010-095.
     
b) Training Required Must be a graduate of Police Intelligence Officers
    Course (PIOC) or its equivalent and preferably a
    graduate of Police Attaché Course (PAC) or other
    related trainings.
     
c) Performance Must have an average of at least Very Satisfactory
  Evaluation Rating (VS) for the last 2 years of service.
  (PER)  
     
d) Minimum Length Must have a minimum of eighteen (18) years of
  of Service active commissioned service.
     
e) Remaining years Must have at least four (4) years of service left
  in service before compulsory retirement reckoned from the
    date of deployment.
     
f) Intelligence Must have at least nine (9) years of accumulated
  Service service in the intelligence community except Police
    Attaché, Washington DC (PA WDC) which shall
    be 12 years;
    Must be a holder of Category II in the Intelligence
    Eligibility List as certified by the Directorate for
    Intelligence (DI) at the time of nomination except
    for Police Attaché, Washington DC (PA WDC)
    which is Category I.
     
g) Driving skill Must be a holder of a Non-Professional driver's
    license for a four-wheeled vehicle for at least one
    (1) year subject to a driving test using the UN
    deployment standard in urban terrain using
    automatic and manual transmission.
     
h) Computer Skill Must be literate in word processing, spreadsheet,
    slideshow presentation, internet browsing, basic
    troubleshooting, and cyber security as certified by
    DI Information Technology (IT) Officer.
     
i) Communication Must be proficient in English: written and verbal
  Skill communication.
     
j) Physical/Mental Must pass the physical, dental, neuropsychiatric,
  Condition and drug tests.

2) Assistant Police Attaché (APA)

a) Rank Must have a rank of PSUPT.
     
b) Training Required Must be a graduate of Police Intelligence Officers
    Course (PIOC) or its equivalent and preferably a
    graduate of Police Attaché Course (PAC) or other
    related trainings.
     
c) Performance Must have an average of at least Very Satisfactory
  Evaluation Rating (VS) during the last 2 years of service.
  (PER)  
     
d) Minimum Length of Must have a minimum of twelve (12) years of
  Service active commissioned service.
     
e) Remaining years in Must have at least four (4) years of service left
  service before compulsory retirement reckoned from the
    date of deployment.
     
f) Intelligence Service Must have six (6) years of accumulated service in
    the intelligence community and to be certified by
    DI as Category III in the Intelligence Eligibility
    List.
     
g) Driving skill Must be a holder of a Non-Professional driver's
    license for a four-wheeled vehicle for at least one
    (1) year subject to a driving test using the UN
    deployment standard in urban terrain using
    automatic and manual transmission.
     
h) Computer Skill Must be literate in word processing, spreadsheet,
    slideshow presentation, internet browsing, basic
    troubleshooting and cyber security as certified by
    DI IT Officer.
     
i) Communication Skill Must be proficient in English: written and
    verbal communication.
     
j) Physical/Mental Must pass the physical, dental,
  Condition neuropsychiatric, and drug tests.

3) Administrative Assistant (AA)

a) Rank Must have a rank of SPO2-SPO4.
     
b) Training Required Must be a graduate of Police Intelligence
    Course (PIC) or its equivalent and preferably a
    graduate of Police Intelligence Foreign
    Administrative Assistant Course
    (PIFAAC) or other related trainings.
     
c) Performance Must have an average of at least Very
  Evaluation Rating Satisfactory (VS) for the past two (2) years of
    service.
     
d) Minimum Length Must have a minimum of twelve (12) years of
  of Service active service.
     
e) Remaining years Must have at least four (4) years of service left
  in service before compulsory retirement reckoned from
    the date of deployment.
     
f) Intelligence Must have five (5) years of accumulated
  Service service in the intelligence community to be
    certified by DI a Category V in the Intelligence
    Eligibility List.
     
g) Driving skill Must be a holder of a Non-Professional driver's
    license for a four-wheeled vehicle for at least
    three (3) years subject to a driving test using
    the UN deployment standard in urban terrain
    using automatic and manual transmission.
     
h) Computer Skill Must be literate in word processing,
    spreadsheet, slideshow presentation, internet
    browsing, basic troubleshooting, and cyber
    security as certified by DI IT Officer.
     
i) Communication Must be proficient in English: written and
  Skill verbal communication.
     
j) Physical/Mental Must pass the physical, dental,
  Condition neuropsychiatric, and drug tests.

b. Special Qualifications

The following shall be considered as among the basis in the selection of candidates, such as:

1) Specialized training related to nominee assignment;

2) Foreign/International Engagement; and

3) Knowledge of the language in the country of assignment.

c. Disqualifications

No Police Commissioned Officer (PCO) or Police Non Commissioned Officer (PNCO) shall be nominated or be eligible for appointment to OPA posts for any of the following reasons:

1) Has been convicted or found guilty of any criminal case involving moral turpitude;

2) Has been found guilty of a grave offense under NAPOLCOM MC 2007-001;

3) Has pending criminal/administrative case, or is a witness in any pending criminal case; aScITE

4) Has derogatory record with Counterintelligence and Security Division, Directorate for Intelligence; or

5) Is a habitual drinker or engages in other vices deemed prejudicial to the conduct of his duties such as but not limited to addiction to alcohol, drugs and gambling.

d. Selection, Nomination, Appointment and Accreditation of OPA Personnel

1) The Board has the primary responsibility in the selection and nomination from among the qualified candidates for OPA positions. The following composes the Board:

Members: - C, IOD
  - C, CSD
  - C, IRC
  - C, FLD
  - GD, ITG
  - C, BFS
  - C, APMS
Head Secretariat - C, FLD

2) The Board shall adopt a criterion on how the candidates will be rated based on their special qualifications and performance during the written/oral examinations and final interview.

3) The selection of OPA post candidates shall be done at least one (1) year prior to the date of expected deployment.

4) The Secretariat, upon instruction of the Board, shall publish the vacancy/ies to all PNP offices/units nationwide and accepts the application folders of interested police officers to the post/s.

5) The Secretariat screens the candidates based on the submitted documents and prepares a shortlist of qualified candidates.

6) Shortlisted candidates shall be informed on the schedule of the pre-screening process and the final deliberation.

7) The Board shall convene to deliberate the shortlisted candidates. The names of successful candidates shall be endorsed through a Board Resolution for approval of TDI for subsequent endorsement to the Chief, PNP for his final approval. After the approval of the C, PNP, a "No Objection Certificate" shall be secured from the host country through the DFA.

8) A Memorandum of Final Deliberation approved by the C, PNP will be forwarded and endorsed to NAPOLCOM then DILG and finally to the Office of the President for the approval of Detail/Deployment.

9) Approved Letter of Detail/Deployment of the President will be coursed back to NAPOLCOM/DILG for information and finally to the PNP for budget allocation/release, issuance of DPRM Detail Order, processing of diplomatic passport, visa and other documentary requirements.

10) The HO, through the Philippine Embassy or Consulate Office, shall obtain the accreditation of the PA, APA or AA from the host country.

11) The HO, through NAPOLCOM/DILG, shall seek approval from the President on the application of Non-Resident Attaché (NRA) of PA in nearby countries of his/her country of accreditation. Furthermore, the HO, through the DFA shall obtain a "No Objection Certificate" from the Head of Post of the countries from where HO is seeking accreditation on behalf of the concerned nominee.

e. Deployment

1) While waiting accreditation from the country of assignment, any nominee who is not organic to the Directorate for Intelligence shall be relieved from the mother unit and will be assigned to the Directorate for Personnel and Records Management — Personnel Holding Accounting Unit (DPRM-PHAU) and will further be detailed to DI for a period of not less than two (2) months for PA or APA nominee and for a period of not less than six (6) months for AA nominee prior to deployment in the country of assignment/accreditation.

2) The APA or AA nominee organic to DI shall be assigned to FLD to make them familiar with the work in OPA post and to prepare for their deployment.

3) Prior to deployment, the nominee shall be required to accomplish the following:

a) Submit a signed Affidavit of Undertaking to finish the three-year tour of duty unless earlier recalled or not to seek extension of the three-year tour of duty.

b) Submit a Country Study on the projected country of assignment/accreditation to FLD, DI at least a month before the date of deployment.

c) Undergo a Pre-Departure Orientation Seminar (PDOS) with the Department of Foreign Affairs.

4) PA and APA shall secure Fidelity Bond prior to deployment. A seminar on proper disbursement of funds shall be undertaken after PDOS.

5) Departure Call to DI Command Group.

f. Post Deployment

1) Outgoing OPA personnel must submit and present to DI Command Group and Staff an After Tour of Duty Report containing therein the accomplishments, best practices learned, and recommendations to further improve the OPA system.

2) The outgoing OPA shall comply with the requirements provided in Section 7 of Joint Circular No. 01-2015 dated April 16, 2015 entitled "Guidelines on the Assignment of Representatives of Partner Agencies to Philippine Foreign Service Posts."

3) After termination of the tour of duty, the PA or APA shall be immediately reassigned to the Directorate for Personnel and Records Management-Personnel Holding Accounting Unit (DPRM-PHAU).

4) OPA personnel must be responsible for the shipment of household goods and personal effects, including a car within a period of two (2) months from the effective date of assignment, recall, resignation, retirement or time of death of the personnel concerned.

g. Duties

1) Police Attaché (PA)

a) Police Duties

a.1) Acts as representative of the Secretary of the Interior and Local Government SILG/Chairman, National Police Commission (NAPOLCOM) and the C, PNP with the police law enforcement agencies of the country of assignment/accreditation;

a.2) Promotes cordial relation and encourage cooperation between the PNP and police/law enforcement agencies and other foreign counterparts/representatives who are also accredited by the country of assignment/accreditation;

a.3) Serves as police adviser to the Head of Post, but shall not perform the duties of an aide-de-camp;

a.4) Determines, collects, evaluates and transmits information of strategic importance to the national interest and internal security of the Philippines on issues pertaining to transnational crimes including but not limited to terrorism, cybercrime and other organized crimes;

a.5) Assists Filipino nationals in the country of assignment/accreditation on police related matters;

a.6) Conducts Security Survey and Inspection (SSI) and determine as well as adopt security measures for the Embassy as directed;

a.7) Provides assistance to visiting PNP personnel within the country of assignment/accreditation;

a.8) Coordinates with local and foreign counterparts in the country of assignment/accreditation to comply with PNP requirements on matters pertaining to police administration, training, operation, investigation, logistics and etc.; HEITAD

a.9) Conducts background investigation of entities on which the PNP have dealings with, as directed;

a.10) Acts as the Special Disbursing Officer in the absence of APA in the OPA posts;

a.11) Supervises the procurement of police supplies in the country of assignment; and

a.12) Performs such other functions as may be directed by the Home Office.

b) Diplomatic Duties

b.1) Extends to the Head of Post such assistance as may be required on matters which the PA may be in a position to give by reason of his professional training and experience;

b.2) Accompanies the Head of Post in appropriate occasions; and

b.3) Attends official functions or social gatherings in relation to OPA's duties and functions in view of enhancing its performance and accomplishment of its mission.

2) Assistant Police Attaché (APA)

a) Assists the PA in the performance of official functions;

b) Performs the duties of the PA during his absence;

c) Acts as PLO or PLA in a Consulate as may be required in the country of deployment;

d) Acts as Special Disbursing Officer (SDO) in the OPA; and

e) Performs such other functions as may be directed by the PA and the Home Office.

3) Administrative Assistant (AA)

a) Helps in the collection efforts of the OPA:

a.1) Does operational and information research work; and

b.2) Takes and processes photographs of important persons/establishments/activities.

b) Performs clerical and secretarial duties:

b.1) Prepares financial reports and clearing instruments;

b.2) Acts on routine communications;

b.3) Devises and maintains an effective filing system; and

b.4) Performs such administrative functions as may be directed by the PA/APA and the home office.

c) Assists in the management of the OPA:

c.1) Attends to the cleanliness and orderliness of the premises;

c.2) Assists in the security of the OPA;

c.3) Operates the communication system;

c.4) Acts as courier of the OPA;

c.5) Promotes cordial relation with other Embassy personnel; and

c.6) Acts as Liaison PNCO of the OPA.

d) Performs property custodian duties:

d.1) Procures office supplies and equipment;

d.2) Maintains records, does maintenance and custody of OPA supplies, equipment and vehicles; and

d.3) Acts as supply accountable officer of the post.

e) Performs other functions: aDSIHc

e.1) Acts as driver when necessary;

e.2) Assists at gatherings tendered by PA/APA; and

e.3) Meets, escorts, guides and helps entertain visitors when so designated.

h. Extension/Early Recall

1) Extension of the three (3)-year tour of duty shall be allowed only for the following reasons:

a) Maximum period of one (1) month to facilitate an orderly and proper turn-over of duties and responsibilities; or

b) Maximum period of three (3) months in case of the unavailability of the incoming PA.

2) OPA personnel shall strictly complete the three-year tour of duty unless earlier recalled for the following reasons:

a) Declared persona non grata by the receiving country;

b) Recommended for recall by the Head of Post and requested by the Secretary of Foreign Affairs;

c) Closure or transfer of post to other country; and

d) Negligence of duty or grave abuse of discretion.

i Non-Resident Attaché

1) A Non-Resident Attaché status may be conferred to a Police Attaché after the determination of its need by the PNP or DFA, accreditation of host country and approval of the President.

2) Travel of the PA from the original country of assignment to country where PA is conferred the status of NRA shall be with prior approval of The Director for Intelligence. 

3) Representation and travelling expenses incurred in the compliance of NRA function shall be separately funded and disbursed for the use of the PA.

j. Compensation

1) In addition to regular salary and allowances, the PA, APA and AA shall receive allowances and other emoluments in the same rate as those paid to a Foreign Service Officer/Staff of DFA.

2) Among the allowances and benefits entitled to the PA, APA and AA are: overseas, family, education, representation, living quarters, clothing, and medical allowances and other forms of allowances authorized to DFA officials in diplomatic post.

3) Personnel assigned to Police Attaché post abroad shall be conferred with the following Foreign Service assimilated ranks for the sole purpose of computing their compensation.

Foreign Service Officers (FSOs)

Police Chief Superintendent - Career Minister
Police Senior Superintendent - FSO I
Police Superintendent - FSO II

Foreign Service Staff Officers (FSSOs)

Senior Police Officer IV - FSSO I
Senior Police Officer III - FSSO II
Senior Police Officer II - FSSO III

4) Operational expenses are granted by the PNP to its PA, APA and AA abroad in such amount sufficient to carry out their duties or satisfy operational requirements.

5) When an OPA personnel is recalled to the HO, he/she shall be paid in accordance with the national compensation for HO personnel and shall cease to be considered Foreign Service personnel.

k. Supervision and Control

1) Administrative and Operational Control

a) OPA personnel shall be under the immediate administrative control and supervision of the Head of Post while assigned at the Philippine Foreign Service Post. Administrative control and supervision shall mean control/supervision of all activities relative to normal housekeeping functions and management of the diplomatic post concerned and shall encompass duties as listed under Diplomatic Duties of this Circular.

b) The C, PNP through DI shall exercise operational control and supervision over all PNP personnel assigned to OPA posts. Operational control and supervision shall mean control/supervision of his/her activities in relation to any task/mission assigned by the Home Office and as listed under Police Duties of this Circular. As such, DI has the authority to approve and dispatch PNP personnel from the intelligence community to conduct visitation/inspection/audit to any of said PNP posts.

2) Home Office Consultation

a) Home Office shall determine the necessity of calling OPA personnel for consultation either in Manila, or to any OPA post or places as may be necessary. The personnel concerned is then advised to proceed to the destination and bring along the necessary documents and/or any other requirements pertinent to the consultation;

b) Should the total consultation period exceed two (2) weeks regardless of any reason/s, the basic overseas allowances is automatically cut-off, unless otherwise approved by the C, PNP. In this case, payment of corresponding overseas allowances shall be resumed on the date of actual return to the post of assignment;

c) Travel from post of assignment to destination and return of personnel on consultation will be at government's expense; and

d) During HO Consultation, PA is required to conduct briefing to the DI Command Group as to achievements, updates and information which must be brought to the attention of the HO.

3) Leave

a) OPA personnel shall be entitled to thirty (30) days vacation leave after a minimum of one (1) year continued service at the post and thirty (30) days sick leave with full pay for each year of service;

b) Sick leave shall be granted on account of the sickness of an OPA personnel or any member of his family under the same condition as those for vacation leave. Application for sick leave covering a period of seven (7) days shall be supported by in every case by a physician's certificate. In this case, PA or APA shall notify the Head of Post while AA shall notify the PA;

c) Married OPA women personnel are entitled to maternity leave of sixty (60) days with full pay after two (2) years of continuous service;

d) The Head of Post shall indorse the leave application of PA, PLA or PLO while PA shall indorse the leave application of APA or AA;

e) The accomplished leave form shall be submitted to the HO within ten (10) working days prior to the effectivity of leave. In case of emergency leave, the HO shall be notified through any expedient mode of communication;

f) OPA personnel cannot leave their post unless authorized by Home Office and the Head of Post;

g) Expenses incurred relative to the leaves shall be shouldered by the concerned OPA personnel;

h) No OPA personnel shall be allowed to go on leave three (3) months prior to his/her recall and/or termination of duty to facilitate an orderly and proper turn-over of post; and

i) OPA personnel shall be allowed a "one month after tour of duty (TOD) leave" upon completing the requirements for the end of TOD. ETHIDa

l. Prohibitions

1) No uniform or decoration shall be used by OPA personnel other than the prescribed PNP uniform. They may wear civilian clothes during appropriate occasions.

2) No OPA personnel will directly or indirectly engage in business or practice any profession in the country of assignment/accreditation during their tour of duty thereat.

3) No OPA personnel is authorized to leave or engage in unnecessary travel outside the country of assignment/accreditation without prior approval/clearance of the HO.

4) No OPA personnel shall employ an alien or local hire in their office without the approval of the HO subject to the regulations issued by DFA.

m. Administrative Sanctions

Any OPA personnel who will be found to have committed infractions/violations of the above-mentioned provisions will be meted administrative sanctions in accordance with the existing policies and regulations governing the PNP.

8. Rescission:

Provisions in other PNP Memorandum Circulars which are contrary to the provisions of this MC are hereby repealed.

9. Effectivity:

This MC takes effect after fifteen (15) days from filing a copy thereof at the University of the Philippines Law Center in consonance with Sections 3 and 4 of Chapter 2, Book VII of Executive Order No. 292, otherwise known as the "Revised Administrative Code of 1987" as amended.
